These Buyer Purchase Terms for Seller Orders govern the conditions that apply when a Buyer purchases products offered by Sellers within MyDealShopper, including purchases made through a Live Store, checkout, products shown during lives, product codes, catalogs, links, product pages, or any flow authorized by MyDeal.
These Terms are intended to:
1. Explain how a purchase made from a Seller within MyDeal works.
2. Establish what the Buyer accepts when purchasing Seller products.
3. Govern payments, shipping, Final Sale products, Claims, returns, refunds, storage, freight, duties, taxes, international shipping, and Buyer Protection.
4. Align the Buyer experience with the policies applicable to Sellers.
5. Protect Buyers, Sellers, MyDeal, MyDeal Xpress, carriers, hubs, payment processors, and other parties involved in the operation.
These Terms apply only to purchases made from Sellers with their own inventory within MyDeal. These Terms do not apply to purchases made through Personal Shoppers, private appointments, personalized sourcing, concierge services, assisted purchasing, creator programs, affiliate programs, or future services, unless MyDeal expressly states that these Terms apply in whole or in part. Such services may be subject to separate terms, policies, fees, claims, refunds, shipping, payout, storage, or other conditions.
By creating an account, using MyDeal, browsing a Live Store, adding products to cart, completing checkout, paying for an order, checking a box, requesting shipping, submitting a Claim, contacting support, or continuing to use the Platform, the Buyer accepts these Terms.
MyDeal may retain electronic acceptance records, including date, time, user, email, IP address, terms version, checkbox text, button clicked, language, user agent, and any other information reasonably necessary to document acceptance.
The recommended checkout checkbox may state:

These Terms apply to:
1. Purchases made from Sellers within MyDeal.
2. Products sold in Live Stores.
3. Products promoted during lives connected to MyDeal.
4. Products purchased through checkout.
5. Domestic orders within the United States.
6. International orders initially sent to a MyDeal Hub.
7. Purchases to Mexico through authorized routes.
8. International purchases outside Mexico through hubs, consolidation, or MyDeal Xpress.
9. Standard Products.
10. Large Items / Oversize Items / Special Cargo.
11. Fragrance / Perfume.
12. Beauty / Cosmetics.
13. Luxury / Designer Items.
14. Pallet / Bulk Lot.
15. Claims, refunds, returns, cancellations, chargebacks, storage, abandonment, and shipping issues related to Seller Orders.
These Terms must be interpreted together with:
1. Seller Terms and Conditions.
2. C1 - Product Condition and Listing Accuracy Policy.
3. C2 - Prohibited and Restricted Products Policy.
4. C3 - Fragrance and Beauty Products Policy.
5. C4 - Luxury / Designer Authenticity Policy.
6. C5 - Pallet / Bulk Lot Policy.
7. C6 - Seller Shipping Eligibility and Fulfillment Policy.
8. C7 - Seller Returns, Refunds and Claims Policy.
9. C8 - Seller Payouts, Reserves, Adjustments and Chargebacks Policy.
10. C9 - Seller Verification, Compliance and Eligibility Policy.
11. MyDeal Privacy Policy.
12. Buyer Protection and Claims Policy for Seller Orders / Política de Buyer Protection y Claims para Seller Orders, when published or applicable.
13. MyDeal Xpress Logistics Terms, when applicable.
14. Stripe, PayPal, or other payment processor terms, when applicable.
15. Carrier rules.
16. Customs rules.
17. Tax rules.
18. Sanctions, AML, fraud prevention, and product safety requirements.
If there is a conflict between these Terms and a more specific policy, the more specific policy will apply to the applicable product, shipping, claim, refund, return, payout, freight, customs, category risk, hub issue, or situation, unless Applicable Law requires otherwise.

| Standard Product | A product eligible for MyDeal’s Standard Shipping flow. |
| Large Item / Oversize Item / Special Cargo | A large, heavy, bulky, fragile, or otherwise non-Standard Shipping eligible product, subject to separate flow, fee, review, quote, carrier, special handling, freight, or rules, as applicable. MyDeal may use “Large Item” as the formal flow and “Oversize Item” or “Oversize / Special Cargo” as an operational or buyer-facing description when needed. |

| Duties / Taxes / Customs Fees | Taxes, duties, customs charges, import fees, brokerage fees, or destination charges applicable to certain international purchases. |
| Buyer Protection | Limited protection offered by MyDeal for certain valid purchase issues, according to these Terms and applicable policies. |
MyDeal operates as a platform that allows Sellers to sell products to Buyers through Live Stores, checkout, and related tools.
Unless MyDeal expressly states otherwise:
1. The Seller is responsible for the products it publishes and sells.
2. The Seller is responsible for listing accuracy.
3. The Seller is responsible for product condition, authenticity, availability, and compliance.
4. MyDeal facilitates technology, checkout, payments, support, shipping tools, hubs, claims, compliance, and logistics as applicable.
5. MyDeal does not guarantee that every product has been inspected, authenticated, or verified before publication.
6. MyDeal may intervene to protect the Buyer, apply policies, process refunds, cancel orders, request evidence, or take action against Sellers.
A purchase within MyDeal does not automatically make MyDeal the manufacturer, owner, official importer, authenticator, insurer, or direct seller of the product, unless MyDeal expressly states a different model for a specific service.
The Buyer understands that product information may come from the Seller, including:
1. Title.
2. Description.
3. Photographs.
4. Videos.
5. Product Type.
6. Condition.
7. Key Details.
8. Price.
9. Inventory.
10. Brand information.
11. Dimensions, volume, color, size, or quantity information.
12. Manifest, when applicable.
13. Information shared during lives.
14. Comments, chats, or messages connected to the sale.
15. Representations made by the Seller.
MyDeal may use the listing, photographs, live content, Buyer evidence, Seller evidence, tracking, hub records, carrier information, and other available elements to resolve Claims.
If there is a contradiction between what was published and what was said or shown by the Seller, MyDeal may consider the representation that reasonably influenced the Buyer’s purchase decision.
Before completing checkout, the Buyer must review:
1. Product name.
2. Description.
3. Photographs.
4. Product Type.
5. Condition.
6. Price.
7. Quantity.
8. Applicable shipping.
9. Final Sale notices.
10. Freight notices.
11. Duties, taxes, or customs notices.
12. Storage rules.
13. Claims deadlines.
14. Destination restrictions.
15. Pallet / Bulk Lot information, when applicable.
16. Manifest, when available.
17. Any checkbox, notice, or condition shown before payment.
The Buyer’s failure to read a visible description, photograph, notice, or condition does not automatically create a right to a refund, return, or Claim, unless there is an issue covered by Buyer Protection.
An order is considered confirmed when:
1. The Buyer completes checkout.
2. Payment is authorized or processed.
3. MyDeal confirms the order or makes it available for processing.
4. The order has not been cancelled due to payment failure, risk review, error, product unavailability, restriction, or non-compliance.
MyDeal may cancel or pause an order before fulfillment when there is:
1. Product unavailability.
2. Obvious pricing error.
3. Product restriction.
4. Shipping restriction.
5. Fraud risk.
6. Payment review.
7. Sanctions / AML review.
8. Claim or safety report.
9. Prohibited product.
10. Seller ineligibility.
11. Technical issue.
12. Missing information.
13. Any other reasonable legal, operational, logistics, or safety reason.
The Buyer must pay the amounts shown at checkout, which may include:
1. Product price.
2. Initial shipping.
3. Large Item Shipping.
4. Sales tax, when applicable.
5. Applicable fees.
6. Freight, when expressly included.
7. Other charges disclosed before payment.
For certain international purchases, the initial checkout may not include all final destination charges, including:
1. International final shipping.
2. Duties.
3. Taxes.
4. Customs fees.
5. Brokerage fees.
6. Import charges.
7. Storage fees.
8. Final freight.
9. Special handling.
10. Destination charges.
When such charges are disclosed as separate, the Buyer remains responsible for paying them according to the applicable flow.
Shipping rates, Large Item charges, Oversize Item / Special Cargo charges, freight estimates, storage fees, package rates, shipping adjustments, special handling, carrier surcharges, hub charges, package rates, and other operational charges may change based on carrier costs, routes, hubs, destination, weight, dimensions, dimensional weight, logistics availability, dashboard configuration, checkout, Help Center, fee schedule, or MyDeal operational rates in effect at the time of the order, quote, label generation, freight request, final shipping request, or applicable process.
Amounts shown in these Terms, Help Center, checkout, dashboard, Shipping Rates Page, or operational communications may reflect initial rates, current rates, estimates, or charges applicable to the corresponding flow. The applicable fee will be the fee that MyDeal displays, publishes, quotes, or confirms in checkout, dashboard, Help Center, fee schedule, shipping quote, freight quote, label process, or operational flow applicable at the time of the operation.
MyDeal may update fees, charges, adjustments, thresholds, weight brackets, routes, hubs, package rates, or shipping criteria without needing to modify these Terms each time, unless Applicable Law requires otherwise.
MyDeal or its payment/tax providers may calculate, collect, report, or remit sales tax when applicable under marketplace facilitator laws, tax rules, or applicable requirements.
Sales tax collected from the Buyer is not Seller income.
For international purchases, the Buyer may be responsible for:
1. Duties.
2. Import taxes.
3. Customs charges.
4. Brokerage fees.
5. Destination fees.
6. Regulatory fees.
7. Carrier import fees.
8. Other charges imposed by authorities, carriers, customs brokers, or logistics providers.
These charges may not be included in the initial checkout unless MyDeal expressly states otherwise.
If the Buyer refuses to pay duties, taxes, customs fees, freight, storage, or international final shipping when such charges apply, the order may be held, stored, returned, abandoned, disposed of, or cancelled under these Terms, MyDeal Xpress Logistics Terms, and applicable policies.
For eligible Standard Products shipped within the United States, checkout may show:
US$4.99 Standard Shipping
This charge applies according to MyDeal rules, including Daily Sales Report, same Seller, same Buyer, same address, and eligible Standard Products.
The Buyer understands that:
1. The shipping charge is managed by MyDeal.
2. The shipping charge is not Seller income.
3. MyDeal selects or manages labels, carriers, routes, and processes.
4. Shipping may be subject to internal adjustments.
5. Standard Shipping availability does not guarantee delivery on an exact date.
6. Large Item / Oversize Item / Special Cargo or Pallet / Bulk Lot products do not automatically qualify for Standard Shipping.
MyDeal may use a Daily Sales Report to group purchases by the same Buyer from the same Seller within a daily window.
For v1, the operational window may be:
12:00 AM PT to 11:59 PM PT
When the Buyer makes additional eligible Standard purchases from the same Seller within the same Daily Sales Report, checkout may show:
US$0.00 additional Standard Shipping
This means the initial Standard shipping for that Seller and period has already been covered according to the MyDeal flow.
If the Buyer makes purchases after the Daily Sales Report closes, a new shipping charge may apply.
For international Buyers, checkout may show:
US$4.99 Initial Shipping to MyDeal Hub
This charge covers only the initial leg from the Seller to the hub assigned by MyDeal.
The Buyer understands that:
1. This charge does not necessarily cover final international delivery.
2. Final delivery from the hub to the Buyer’s country is paid separately.
3. MyDeal may use hubs such as Texas/Laredo, Florida/Tampa, or others.
4. MyDeal may group, consolidate, separate, or process products at the hub.
5. Final international shipping may depend on weight, dimensions, destination, carrier, country, duties, taxes, and MyDeal Xpress rules.
6. The Buyer must pay final international shipping for the package to be shipped from the hub to the final destination.
When an international order arrives at a MyDeal Hub, MyDeal or its authorized providers may:
1. Receive packages.
2. Register packages.
3. Open boxes.
4. Separate products by Buyer.
5. Verify basic information.
6. Detect visible shortages.
7. Consolidate products.
8. Repack.
9. Prepare international shipping.
10. Calculate final shipping.
11. Request payment from the Buyer.
12. Temporarily hold products until the Buyer completes required instructions or payments.
Receipt of a package at a hub does not mean MyDeal has authenticated, certified, fully inspected, or accepted all merchandise without reservation.
The Buyer must request, confirm, or pay final international shipping according to the flow enabled by MyDeal or MyDeal Xpress.
The final cost may depend on:
1. Destination country.
2. Postal code.
3. Actual weight.
4. Dimensional weight.
5. Package size.
6. Number of products.
7. Consolidation.
8. Carrier.
9. Duties.
10. Taxes.
11. Customs rules.
12. Restricted product.
13. Category.
14. Service level.
15. Additional insurance or protection.
16. Special handling.
The Buyer understands that estimated costs are not necessarily final quotes unless MyDeal expressly states otherwise.
For international products received at a hub, MyDeal may offer free storage depending on the applicable plan, membership, or rule.

After the free period:
1. Storage fees may apply.
2. MyDeal may send notices to the Buyer.
3. The Buyer must request final shipping, consolidation, authorized pickup, or resolve the package.
4. If the Buyer does not respond, pay, or complete the process, the package may be subject to abandonment, disposal, return, sale, donation, destruction, or handling under MyDeal Xpress Logistics Terms and Applicable Law.
A package may be considered abandoned if:
1. The Buyer does not pay final international shipping.
2. The Buyer does not respond to communications.
3. The Buyer does not pay storage fees.
4. The Buyer does not provide required information.
5. The Buyer does not claim the package within the applicable period.
6. The Buyer refuses delivery without a valid Claim.
7. The Buyer refuses to pay duties, taxes, or customs fees.
8. The package cannot be delivered for reasons attributable to the Buyer.
Before disposing of a package, MyDeal may send reasonable notices under its policies and Applicable Law.
Abandonment may result in the Buyer losing rights to the package, without refund, unless Applicable Law requires otherwise.
A Large Item, also referred to operationally as an Oversize Item or Special Cargo when applicable, is a product that is large, heavy, bulky, fragile, or not eligible for Standard Shipping.
For v1, checkout may show:
US$39 Large Item Shipping
The Buyer understands that:
1. Large Item does not qualify for US$4.99 Standard Shipping.
2. Large Item is handled as a separate flow.
3. Large Item is not automatically grouped with Standard Products.
4. If the purchase is international, final international shipping may be paid separately.
5. MyDeal may require weight, dimensions, validations, or a special carrier.
6. Large Item availability may vary by destination, carrier, route, and category.
Pallet / Bulk Lot products are subject to special rules.
When the Buyer purchases a Pallet / Bulk Lot, the Buyer accepts that:
1. The lot is sold as a special commercial unit.
2. The lot price does not include freight unless MyDeal expressly states otherwise.
3. Freight is requested, quoted, confirmed, and paid separately.
4. Freight tables or estimates are informational only, not final quotes.
5. The lot will not be released, picked up, shipped, or delivered until applicable freight has been resolved according to the MyDeal process.
6. The lot may be subject to Final Sale.
7. The Buyer must review description, photographs, condition, manifest, and freight notices before purchase.
8. MyDeal may cancel or pause operations if freight is not viable, if there are restricted products, if the lot does not match, or if there is a logistics issue.
The checkout or product page must visibly show:
FINAL SALE - FREIGHT NOT INCLUDED
And may include an acceptance similar to:
I understand that freight is not included in the lot price. I will need to request and pay freight separately through MyDeal before the lot can be released or shipped.

Unless MyDeal expressly states otherwise, Seller sales are Final Sale with respect to:
1. Change of mind.
2. Personal preference.
3. Buyer remorse.
4. Price comparison.
5. Resale expectations.
6. Subjective dissatisfaction.
7. Failure to read the description.
8. Failure to review photographs.
9. Failure to review visible conditions.
10. Failure to review shipping, freight, taxes, or restrictions.
11. Failure to pay freight or international final shipping after accepting that it was separate.
12. Failure to obtain the expected resale margin.
13. Failure to receive brands or products that were not guaranteed.
14. Pallet / Bulk Lot without manifest where exact contents were not guaranteed.
The Final Sale rule does not eliminate Buyer Protection when there is a valid Claim.
The Buyer may be entitled to review if there is:
1. Incorrect product.
2. Product not received.
3. Missing product.
4. Product damaged before shipping or due to insufficient packaging.
5. Materially different product.
6. Counterfeit product.
7. Undisclosed prohibited product.
8. Product subject to recall.
9. Fragrance opened, used, without permitted box, counterfeit, or non-compliant.
10. Beauty opened, used, expired, repackaged, counterfeit, or non-compliant.
11. Luxury / Designer item that is counterfeit, replica, or materially different.
12. Pallet / Bulk Lot materially different from the listing.
13. Manifest materially incorrect.
14. Freight falsely promised as included.
15. Non-delivery attributable to the Seller, hub, carrier, or covered process.
16. Error covered by applicable policies.
MyDeal will determine in good faith whether the Claim is valid.
Unless another valid basis exists, Claims generally will not proceed for:
1. Change of mind.
2. Buyer found a better price.
3. Buyer expected another resale margin.
4. Buyer did not read the description.
5. Buyer did not review photos.
6. Buyer did not review Final Sale.
7. Buyer did not review separate freight.
8. Buyer did not review final international shipping.
9. Minor non-material variations.
10. Wear or condition clearly described.
11. Subjective dissatisfaction with scent, color, size, style, fit, or texture.
12. Duties, taxes, or customs fees the Buyer did not expect but that were applicable.
13. Customs or carrier delays not attributable to MyDeal or Seller.
14. Pallet without manifest that did not include non-guaranteed products.
15. Buyer opened, used, altered, or damaged the product after receiving it.
16. Buyer provided an incorrect address.
17. Buyer refused delivery without a valid Claim.
18. Buyer did not pay final shipping or storage.
19. Buyer did not respond to necessary communications.
20. Carrier Claim not approved by carrier.
The Buyer must submit Claims within the deadlines indicated by MyDeal.

MyDeal may accept Claims outside the deadline if there is fraud, counterfeit product, prohibited product, recall, safety issue, legal obligation, serious error, or evidence that justifies an exception.
For international orders, the Claim deadline may depend on when the issue could reasonably be detected.

MyDeal may adjust these deadlines when carrier events, customs events, hub processing, evidence, or operational circumstances justify it.
MyDeal may request reasonable evidence from the Buyer, including:
1. Photographs of the product received.
2. Photographs of outer packaging.
3. Photographs of shipping label.
4. Opening video, if available.
5. Photographs of damage.
6. Photographs of missing accessories.
7. Screenshots of listing or live.
8. Description of the issue.
9. Order number.
10. Tracking.
11. Authenticity evidence or external report in luxury cases.
12. Photographs of lot or manifest discrepancies for pallets.
13. Customs, duties, or carrier documents.
14. Carrier case number.
15. Signed statement.
16. Police report, when applicable.
17. Any other reasonable evidence according to category.
Insufficient evidence may result in denial or limitation of the Claim.
The Buyer must not return products without prior authorization from MyDeal.
A valid return may require:
1. MyDeal approval.
2. Return label.
3. Authorized address.
4. Authorized carrier.
5. Shipping deadline.
6. Complete product.
7. Proper packaging.
8. Included accessories.
9. Order number.
10. Delivery evidence.
Unauthorized returns may be rejected, not refunded, delayed, returned to the Buyer, or handled under applicable policies.
The Buyer must not return the following without instructions from MyDeal:
1. Opened fragrances.
2. Opened beauty products.
3. Damaged or contaminated products.
4. Dangerous products.
5. Prohibited products.
6. Counterfeit products.
7. Products subject to safety issues.
8. International products held by customs.
9. Pallet / Bulk Lot.
10. Large Item / Oversize Item / Special Cargo.
11. Products requiring special carrier.
12. Products whose return is illegal, unsafe, or not viable.
MyDeal may determine whether refund without return, destruction, disposal, return to Seller, product review, or any other permitted remedy is appropriate.
MyDeal may issue full or partial refunds when:
1. There is a valid Claim.
2. The Seller cannot fulfill the order.
3. The product is incorrect.
4. The product is counterfeit.
5. The product is prohibited.
6. The product is not delivered.
7. The product is materially different.
8. The product is damaged in a covered way.
9. MyDeal determines Buyer Protection applies.
10. Applicable Law requires it.
11. The processor, carrier, or applicable policy requires it.
Refunds may exclude certain non-refundable charges when appropriate, including:
1. Shipping already used.
2. Freight already incurred.
3. Duties.
4. Taxes.
5. Customs fees.
6. Storage fees.
7. Carrier fees.
8. Return fees.
9. Handling fees.
10. Other non-recoverable charges, unless the issue is attributable to the Seller, MyDeal, or a covered party.
MyDeal may cancel an order in whole or in part when:
1. The Seller has no stock.
2. The Seller cannot fulfill.
3. The product is misclassified.
4. The product is prohibited.
5. The product cannot be shipped.
6. Payment fails.
7. There is fraud or risk review.
8. There is an obvious pricing or listing error.
9. The Buyer requests cancellation before processing, if MyDeal allows it.
10. The Seller breaches policies.
11. The carrier or hub cannot process.
12. The law or an authorized third party requires it.
13. MyDeal determines the order is not viable.
If cancellation occurs before shipping and without Buyer fault, MyDeal may issue a refund according to the applicable situation.
If tracking shows delivered, but the Buyer states the package was not received, MyDeal may request:
1. Address confirmation.
2. Photographs of delivery area.
3. Carrier proof of delivery.
4. GPS or delivery scan, when available.
5. Buyer statement.
6. Carrier contact.
7. Police report, when applicable.
8. Internal investigation.
A delivered status does not automatically guarantee denial of the Claim, but the Buyer must cooperate with the investigation.
MyDeal may deny the Claim if evidence shows reasonable delivery or if there is fraud, incorrect address, refusal of delivery, lack of cooperation, or suspicious conduct.
The Buyer is responsible for providing a correct, complete, and deliverable address.
If the Buyer provides an incorrect, incomplete, undeliverable, or outdated address, the Buyer may be responsible for:
1. Package loss.
2. Delays.
3. Return to sender.
4. Reshipment.
5. Additional shipping.
6. Storage.
7. Duties.
8. Carrier fees.
9. Package abandonment.
10. No refund, unless law or MyDeal determines otherwise.
If an order contains a prohibited, restricted, not enabled, or shipping-incompatible product, MyDeal may:
1. Cancel the order.
2. Hold processing.
3. Request information.
4. Reject shipping.
5. Issue a refund.
6. Hold or dispose of the product when legally appropriate.
7. Cooperate with authorities, processors, carriers, brands, or regulators.
8. Suspend the Seller.
9. Deny delivery if law or safety requires it.
The Buyer is not entitled to demand delivery of a prohibited, illegal, unsafe, restricted, or non-transportable product.
Permitted perfumes and fragrances must be:
1. New.
2. Authentic.
3. Sealed.
4. Unused.
5. In intact original retail packaging.
6. Correctly published as Fragrance / Perfume.
The Buyer must review size, volume, presentation, set, photographs, and description before purchase.
Returns generally will not be accepted for subjective scent preference, intensity, longevity, comparison with another perfume, or change of mind, provided the product materially matches the listing.
A valid Claim may exist if the product is counterfeit, used, opened, lacks permitted packaging, is damaged, incorrect, or materially different.
Permitted Beauty / Cosmetics products must be:
1. New.
2. Unopened.
3. Unused.
4. Not expired.
5. Not repackaged.
6. Not in aerosol form, unless MyDeal enables that category in the future.
7. In intact original retail packaging.
8. Correctly published.
Returns generally will not be accepted for subjective shade, texture, preference, change of mind, price comparison, or subjective dissatisfaction if the product materially matches the listing.
A valid Claim may exist if the product is opened, used, expired, damaged, contaminated, counterfeit, incorrect, or materially different.
Luxury / Designer Items are subject to special authenticity rules.
The Buyer understands that:
1. The Seller is responsible for publishing only authentic items.
2. MyDeal does not automatically authenticate every item before publication.
3. Publication on MyDeal does not mean automatic certification of authenticity.
4. MyDeal may request evidence from the Seller.
5. MyDeal may review counterfeit or materially different product Claims.
6. The Buyer must review photos, condition, accessories, serials, description, and Final Sale notices.
A valid Claim may exist if the item is counterfeit, a replica, materially different, has undisclosed damage, is missing an announced accessory, or does not match the listing.
There is no automatic Claim for clearly described wear, subjective preference, change of mind, or resale expectations.
Pallet / Bulk Lot purchases are Final Sale with respect to change of mind, commercial expectations, and subjective preferences.
The following generally are not valid Claims by themselves:
1. Buyer expected a higher margin.
2. Buyer expected other brands that were not guaranteed.
3. Buyer did not review the manifest.
4. Buyer purchased a lot without manifest and expected specific contents.
5. Buyer did not consider separate freight.
6. Buyer did not obtain resale profit.
7. Buyer did not read Final Sale.
The following may be valid Claims:
1. Materially different lot.
2. Materially incorrect manifest.
3. Counterfeit products.
4. Undisclosed prohibited products.
5. Lot not delivered.
6. Freight falsely promised as included.
7. Damage attributable before pickup.
8. Fraud.
9. Stolen merchandise.
10. Materially different condition.
If the Buyer initiates a chargeback or dispute with the Buyer’s bank, card, or processor, MyDeal may:
1. Share evidence with the processor.
2. Suspend internal review.
3. Request additional information.
4. Respond according to processor rules.
5. Limit duplicate refunds.
6. Reject chargeback abuse.
7. Apply fraud or account limitation policies.
8. Take actions permitted by law.
The Buyer must not receive double recovery for the same issue through both refund and chargeback.
MyDeal may deny Claims, limit accounts, cancel orders, or suspend access when it detects:
1. False Claims.
2. Abusive chargebacks.
3. Manipulated photographs.
4. False address.
5. Return fraud.
6. Fraudulent empty-box Claims.
7. Promotion misuse.
8. Data resale.
9. Attempt to obtain a refund without returning the product when return is required.
10. Collusion with Seller.
11. Suspicious activity.
12. Sanctions / AML risk.
13. Conduct contrary to law or policies.
MyDeal may allow or facilitate certain communications between Buyer and Seller to resolve questions, lives, products, or orders.
The Buyer must not:
1. Move transactions outside MyDeal.
2. Pay the Seller directly for orders initiated on MyDeal.
3. Share payment information outside the Platform.
4. Request evasion of fees, shipping, taxes, or Buyer Protection.
5. Threaten, harass, or abuse Sellers.
6. Request prohibited products.
7. Ask the Seller to alter customs declarations or shipping information.
8. Use Seller data for purposes unrelated to the order.
MyDeal may limit communications, cancel orders, or suspend accounts if it detects abuse.
MyDeal does not guarantee:
1. That a product will remain available.
2. That a Seller will maintain inventory.
3. That a price does not contain an obvious error.
4. That shipping is available to all destinations.
5. That carriers will deliver without delay.
6. That customs will release a package.
7. That a product will be accepted by all countries.
8. That a Pallet / Bulk Lot will produce resale margin.
9. That a product will be delivered on an exact date.
10. That a live or Seller will remain active.
MyDeal may modify these Terms to reflect:
1. Operational changes.
2. New categories.
3. Shipping changes.
4. New hubs.
5. Carrier changes.
6. Legal changes.
7. Tax changes.
8. Compliance changes.
9. Buyer Protection changes.
10. Claims, refunds, or storage changes.
11. Payment processor changes.
12. New services.
Continued use of MyDeal after an update is published may constitute acceptance of the updated version, to the extent permitted by Applicable Law.
MyDeal may send notices related to:
1. Orders.
2. Payments.
3. Shipping.
4. Hubs.
5. Storage.
6. Claims.
7. Refunds.
8. Returns.
9. Chargebacks.
10. Terms.
11. Policies.
12. Security.
13. Compliance.
14. Account status.
15. International shipping.
16. Freight.
17. Abandonment.
18. Legal notices.
Notices may be sent by email, dashboard, account messages, platform alerts, SMS when permitted, support, or any other reasonable electronic method.
The Buyer is responsible for checking their registered channels.
The use of the Buyer’s personal information is governed by the MyDeal Privacy Policy.
MyDeal may process Buyer information to:
1. Create account.
2. Process checkout.
3. Process payment.
4. Coordinate shipping.
5. Resolve Claims.
6. Prevent fraud.
7. Comply with legal obligations.
8. Share necessary information with Sellers, carriers, hubs, processors, tax providers, logistics providers, and authorities when applicable.
To the maximum extent permitted by Applicable Law, MyDeal will not be liable for:
1. Indirect losses.
2. Lost profits.
3. Lost resale opportunity.
4. Lost expected margin.
5. Consequential damages.
6. Carrier delays.
7. Customs delays not attributable to MyDeal.
8. Buyer errors.
9. Misuse of the Platform.
10. Products published by Sellers, except responsibilities that law does not allow to be excluded.
11. Third-party failures.
12. Events outside MyDeal’s reasonable control.
MyDeal’s liability, if any, may be limited to the amount paid by the Buyer for the affected order, unless Applicable Law requires otherwise.
Nothing in these Terms constitutes legal, tax, customs, regulatory, financial, import/export, or professional advice.
The Buyer is responsible for understanding their obligations regarding:
1. Importation.
2. Duties.
3. Taxes.
4. Customs.
5. Resale.
6. Licenses.
7. Permits.
8. Country restrictions.
9. Product use.
10. Applicable legal compliance.
Unless Applicable Law requires otherwise, these Terms will be governed by the laws of the State of Wyoming, United States, without giving effect to conflict-of-law principles.
Any dispute must first be handled through MyDeal’s internal review procedures before legal action is initiated, unless urgent action, injunctive relief, fraud prevention, chargeback response, processor compliance, or immediate legal compliance is required.
If these Terms are provided in more than one language, the English version will control in case of conflict, unless Applicable Law requires otherwise.
These Terms are incorporated into the Buyer purchase process within MyDeal.

In the event of a conflict, inconsistency, or difference in interpretation, this English version controls unless applicable law requires otherwise.
PBT1 sets the terms that apply when Buyers purchase through Personal Shopper Orders, Live Stores, Private Shopping, Assisted Purchase, products published in My Live Store, or other assisted in-store purchases made through MyDealShopper.
This document explains the commercial and operational conditions of this purchase model. PBT1 does not promise product availability, final price, substitutions, returns, refunds, MyDeal Credit, shipping, international delivery, customs clearance, authenticity, replacement, or any specific result.
PBT1 is part of MyDealShopper's Buyer-facing contractual framework and must be read together with GT1 — MyDealShopper Terms of Use, PP1 — Privacy Policy, MT1 — Membership Terms when applicable, PBT2 — Buyer Protection, Claims and Remedies for Personal Shopper Orders, and the specific terms, disclosures, and conditions shown in checkout, the booking page, order page, shipping flow, or Help Center for the particular transaction.
PS1–PS5, PS-OCS, and the PS-OCS Active Schedule are internal or contractual documents used by MyDealShopper to manage Personal Shoppers, their operations, compensation, compliance, and incident investigations. They are not incorporated into the Buyer's agreement, do not impose obligations on the Buyer, and do not require Buyer acceptance. MyDealShopper may use them internally to administer an order and determine responsibility without reducing Buyer-facing rights under PBT1, PBT2, checkout, or applicable law.
If an order involves a Seller selling its own inventory, Seller Order rules and Seller Terms apply. If the purchase is made through a Personal Shopper, PBT1 applies together with the applicable Buyer-facing and operational documents.
PBT1 applies to purchases, bookings, authorizations, and orders placed by Buyers through Personal Shoppers within MyDealShopper, including Live Store, Private Shopping, Assisted Purchase, products published in Product Inventory or My Live Store, checkout, MyDeal Credit, substitutions, price changes, unavailable products, U.S. shipping, international shipping, hubs, labels, handoff, drop-off, and Pickup Approved when enabled.
PBT1 does not govern claims, returns, or Buyer Protection in detail; those topics are addressed in PBT2. It also does not govern internal payments to Personal Shoppers, Personal Shopper conduct, or complete internal operating procedures.
Buyer: a user who purchases, books, authorizes, or requests an assisted purchase through MyDealShopper.
Personal Shopper: an independent service provider authorized by MyDealShopper to assist Buyers with in-store purchases, Live Stores, Private Shopping, or Assisted Purchase. A Personal Shopper is not a Seller merely because the Personal Shopper assists with a purchase.
Personal Shopper Order: an order in which the Buyer purchases or authorizes the purchase of products through a Personal Shopper, subject to actual in-store availability, checkout, authorization, shipping rules, evidence, and MyDealShopper's operating flow.
Live Store: a live assisted-shopping experience operated by a Personal Shopper from a store, outlet, mall, event, or other authorized location, where products may be published in My Live Store and purchased through MyDealShopper.
Private Shopping: a private assisted-shopping appointment in which a Personal Shopper assists the Buyer according to the booking, fee, duration, operating buffer, and then-current rules.
Assisted Purchase: an in-store or assisted purchase performed by a Personal Shopper through a flow authorized by MyDealShopper.
My Live Store: the operating space where products published by a Personal Shopper are displayed during a Live Store or other enabled flow.
Product Inventory: the tool through which a Personal Shopper records or manages products for My Live Store or other enabled flows.
Published Product: a product that is visible, recorded, or displayed in My Live Store or Product Inventory. A published product is not necessarily reserved, held, purchased, or guaranteed.
Seller Order: an order involving a Seller that sells its own inventory under Seller Terms. It must not be confused with a Personal Shopper Order.
Live Deals: promotions, offers, campaigns, or commercial content that may include Sellers or other formats. They must not be confused with Live Stores operated by Personal Shoppers.
MyDeal Credit: platform credit that MyDealShopper may issue as a Buyer-facing remedy when appropriate. It is not automatic or guaranteed.
Checkout: the flow through which the Buyer reviews, confirms, pays, preauthorizes, or authorizes an order, appointment, commission, shipping, taxes, fees, or other applicable charges.
Authorization: approval by the Buyer or MyDealShopper, within the applicable flow, to begin, continue, adjust, substitute, or complete a purchase.
Substitution: replacement of a product, variant, size, color, model, condition, presentation, or bundle with another authorized product or variant under the applicable flow.
Handoff: recorded delivery of a product to a carrier, hub, authorized location, authorized Personal Shopper, Buyer, or authorized recipient under the applicable flow.
Hub: an operating location, consolidation center, receiving center, or processing facility used by MyDealShopper for domestic or international logistics flows.
Carrier: a transportation, parcel, or logistics provider used to move an order within the United States, to a hub, or to an international destination.
Pickup Approved: an operating method expressly enabled by MyDealShopper for certain orders to be delivered directly to the Buyer or an authorized recipient, subject to specific eligibility and evidence requirements.
A Seller Order involves a Seller selling its own inventory under Seller Terms. A Personal Shopper Order involves an assisted purchase in which a Personal Shopper helps the Buyer acquire products available at a store, outlet, mall, event, or other authorized location. In a Personal Shopper Order, availability, final price, condition, variants, store restrictions, and shipping may change before the in-store purchase is completed.
Live Deals may refer to offers, promotions, campaigns, or commercial content that is not necessarily operated by a Personal Shopper. A Live Store is an assisted-shopping experience operated by a Personal Shopper in real time or through an enabled flow. A Live Store does not make the Personal Shopper a Seller and does not guarantee availability of a displayed product.
A Personal Shopper Order is subject to checkout, authorization, actual in-store availability, possible price changes, substitutions, category restrictions, shipping, handoff, hub, carrier, and operational review. The Buyer understands that a product may not be reserved until it is physically purchased or confirmed under the applicable flow.
A Live Store allows the Buyer to purchase products shown or published by a Personal Shopper during a live session or other enabled flow. Products visible in My Live Store remain subject to availability, price, store restrictions, Product Types, shipping, and applicable authorization.
Private Shopping is a private assisted-shopping appointment. The Private Shopping fee covers the Personal Shopper's time and assistance service, not the price of products, taxes, shipping, duties, insurance, platform fees, product commission, or other charges unless checkout expressly states otherwise.
A product published in Product Inventory or My Live Store is not necessarily held, reserved, guaranteed, purchased, or available at checkout or at the time of the in-store purchase. The store may change price, stock, promotions, policies, restrictions, or availability outside MyDealShopper's control. Products shown during a Live Store or Private Shopping appointment that have not yet been published are likewise subject to actual availability, final price, authorization, checkout, store restrictions, substitutions, and the applicable operating flow before purchase.
Personal Shopper Orders depend on actual in-store availability. A product shown live, published in My Live Store, or requested during Private Shopping may sell out, vary, be damaged, be restricted, be Final Sale, or be unavailable for purchase due to store, carrier, MyDealShopper, or destination-country rules.
The actual price may differ from the price first viewed, published, discussed, or estimated. If the final price is lower, MyDealShopper may reflect the difference through MyDeal Credit, an internal adjustment, a partial refund, or another mechanism shown in checkout or determined by MyDealShopper. If the price increases within the then-current Price Tolerance, the purchase may be completed under the applicable disclosure, checkout, or flow. If it exceeds the Price Tolerance, new authorization may be required.
Sales tax may vary by store, state, city, category, promotion, shipping destination, or checkout configuration. Sales-tax differences do not necessarily constitute a change in product price and will be handled under checkout and applicable tax rules.
The Buyer may be responsible for shipping, duties, customs, insurance, platform fees, processor fees, taxes, regulatory charges, import or export charges, and other applicable amounts. These charges may be shown or calculated in checkout, the order page, shipping flow, or then-current documentation.
The Buyer must review and complete checkout, payment, preauthorization, or other applicable authorization before MyDealShopper or the Personal Shopper performs the purchase, except under a special program authorized by MyDealShopper. Live comments, messages, screenshots, verbal intent, or informal requests do not replace checkout or valid authorization. Specific information displayed in checkout, the order page, booking page, shipping flow, or confirmation screen for a particular order, appointment, or purchase supplements PBT1 and controls that transaction with respect to nonmaterial operational differences.
A Personal Shopper Order is formally created when the Buyer completes checkout and payment or authorization is accepted by MyDealShopper or its payment processor. Before that time, MyDealShopper does not guarantee that the product will be purchased, reserved, or processed.
The Personal Shopper may begin purchasing only after MyDealShopper authorizes the order and the Personal Shopper receives the purchase notification or confirmation through MyDealShopper's flow. No external agreement authorizes a purchase outside the system.
If a product is unavailable, cannot be purchased, has changed condition, is sold out, is restricted, or requires additional authorization, MyDealShopper may omit it, cancel it, substitute it when authorized, issue MyDeal Credit, process an adjustment, or resolve the matter under PBT2, checkout, the Dashboard, or the then-current support flow.
If the Buyer does not respond to a request concerning authorization, substitution, price change, special condition, Final Sale, Open Box, bundle, or another material change, the Personal Shopper must not purchase without authorization when authorization is required. MyDealShopper may omit the product, cancel that portion of the order, apply previously configured preferences when available, or resolve the matter under the applicable flow.
A substitution may be used when a product, variant, size, color, model, condition, or bundle is unavailable or requires adjustment. A substitution may require the Buyer's express authorization or may be covered by configured preferences when the system permits.
Authorization is required when a substitution materially changes the product, size, color, model, condition, presentation, bundle, price, category, brand, availability, Final Sale status, Open Box status, or another element that could reasonably affect the Buyer's decision.
When MyDealShopper enables substitution preferences, the Buyer may configure them before or during the purchase flow. In a Live Store, preconfigured preferences may apply when the system permits; in Private Shopping, the Buyer may authorize substitutions during the appointment through approved channels.
Changes in size, color, model, condition, presentation, bundle, or version are not automatically equivalent. They may require express authorization, additional evidence, or review even when the price remains within the Price Tolerance.
A Final Sale product may not be returnable, refundable, or exchangeable by the store. By authorizing or completing checkout for a Final Sale product, the Buyer understands that a return may be unavailable and MyDealShopper does not guarantee that the store will accept a return, refund, or exchange.
Open Box products may be purchased only when permitted and authorized under the applicable flow. Their condition, packaging, accessories, warranty, returnability, or availability may differ, and they may require additional evidence or authorization.
Clearance products may be subject to final pricing, limited availability, no-return rules, store restrictions, incomplete packaging, or rapidly changing stock. MyDealShopper does not guarantee that they can be returned or replaced.
Beauty, fragrance, cosmetics, and skincare products may be subject to hygiene, shipping, carrier, import, sealed-packaging, no-return, Final Sale, or special-handling restrictions. Opened, used, spilled, visibly expired, or compromised products may be ineligible unless expressly authorized.
MyDealShopper does not independently guarantee authenticity unless a specific policy, program, verification, authorized store, documentation, or disclosure states otherwise. When a product is purchased from an official store, official outlet, or authorized retailer, the principal evidence will be the receipt, store, packaging, and available records.
Electronics may be subject to exact-model, compatibility, region, built-in battery, warranty, serial-number, activation, carrier, import/export, or hidden technical-defect issues. MyDealShopper does not guarantee technical performance except under a specifically applicable policy.
Used or secondhand products are not permitted unless MyDealShopper expressly enables the relevant category, store, condition, or program. If enabled, they may be subject to additional evidence, restrictions, and limited or no warranties or returns.
The Buyer must not request prohibited or restricted products, including medications, alcohol, tobacco, CBD, weapons, ammunition, animals, perishable food, hazardous materials, or any product prohibited by law, carrier, store, MyDealShopper, origin country, destination country, or applicable import/export rule.
Purchases depend on store, mall, outlet, event, security, staff, recording, quantity-limit, membership, Final Sale, return, payment-method, availability, and other third-party rules. MyDealShopper does not control those rules.
Live Stores may be streamed on external platforms such as TikTok, Instagram, Facebook, or other networks when applicable. Those platforms have their own rules and may interrupt, restrict, or remove streams. If an external stream ends, the Live Store within MyDealShopper may remain active until the Personal Shopper completes the service in accordance with the then-current flow.
The Private Shopping fee is charged at booking. The visible duration, operating buffer, then-current fee, economic split, and eligibility conditions are published in checkout, the Dashboard, PS-OCS, the Active Schedule, Help Center, or then-current documentation. The appointment fee may exclude products and additional charges.
When applicable, the Buyer may see the Personal Shopper's commission before booking or purchasing, whether as a percentage, fixed amount, per-product commission, or other enabled configuration. The commission may vary by Live Store, Private Shopping, product, region, campaign, category, or Active Schedule.
Unless MyDealShopper expressly states otherwise, taxes, shipping, duties, insurance, platform fees, processor fees, official tips when enabled, financing charges, and other additional charges are not part of the Personal Shopper's commission and are charged separately through checkout.
Benefits, discounts, fees, priority, shipping, features, or purchase conditions may vary by Free, Plus, Business, or another then-current membership under MT1, checkout, the Dashboard, Help Center, or applicable documentation. PBT1 does not promise specific membership benefits.
MyDealShopper does not guarantee that a product shown, published, discussed, or requested will be available at the time of the in-store purchase. Availability depends on the store, stock, staff, restrictions, promotions, hours, location, and other outside factors.
MyDealShopper does not guarantee a final price except as confirmed or authorized in checkout and subject to Price Tolerance, sales tax, shipping, duties, additional charges, store changes, substitutions, and applicable rules.
MyDealShopper does not independently guarantee authenticity unless a specific program, verification, authorized retailer, documentation, or disclosure applies. The Buyer must review available information and understands that authenticity claims will be handled under PBT2 and available evidence.
Whether a store accepts a return depends on the store, condition, category, date, receipt, payment method, Final Sale, Open Box, clearance, hygiene, shipping, import, and other restrictions. MyDealShopper does not guarantee that a store will accept a return, exchange, refund, or store credit.
MyDealShopper does not guarantee specific delivery times, customs acceptance, absence of duties, import clearance, carrier availability, final customs costs, or a particular international logistics result. International shipments may be subject to review, restrictions, documentation, hubs, and a final carrier.
For shipments within the United States, MyDealShopper may use a carrier, shipping labels, handoff, drop-off, pickup, hub, or other domestic flow. Availability depends on checkout, address, product, carrier, category, and then-current configuration.
For international shipments, MyDealShopper administers the applicable logistics process, including hub receipt, consolidation, review, documentation, international shipping, final carrier, customs, duties, import/export restrictions, and fees shown when the Buyer selects international shipping. Selecting international shipping does not guarantee the absence of additional charges, delays, or restrictions.
Handoff means recorded delivery under the applicable flow, including delivery to a carrier, hub, authorized location, drop-off point, approved pickup recipient, or other authorized person. Evidence of handoff may be required before the logistics or support process continues.
Pickup Approved is available only when MyDealShopper expressly enables it for an order, area, Buyer, Personal Shopper, or program. The Buyer may not demand Pickup Approved when it is not displayed as available or when MyDealShopper removes it for operational, security, risk, or compliance reasons.
If the Buyer cancels before the product is purchased, the cancellation will be handled under checkout, PBT2, the Cancellation Policy, the Dashboard, Help Center, or the then-current support flow. PBT1 does not promise an automatic refund, MyDeal Credit, or other remedy.
If the Buyer cancels after the product has been purchased, the order may be subject to store policy, Final Sale, shipping, import, returns, store credit, MyDeal Credit, PBT2, and costs already incurred. A post-purchase cancellation does not guarantee a refund or return.
If the Buyer changes their mind before purchase, MyDealShopper may handle the request under the applicable flow. If the Buyer changes their mind after purchase, no return, refund, store credit, MyDeal Credit, replacement, or cancellation is guaranteed. The Personal Shopper may not decide or promise remedies.
If a store issues store credit, a gift card, refund, cashback, points, rewards, a coupon, price adjustment, or another benefit arising from a Personal Shopper Order, MyDealShopper will determine its treatment under PBT2, checkout, and applicable policies. The Buyer must not assume that the benefit will automatically be delivered to the Buyer unless MyDealShopper confirms it.
MyDealShopper may offer MyDeal Credit as a Buyer-facing remedy when appropriate. It is not automatic or guaranteed and is governed by PBT2, checkout, the Dashboard, Help Center, or other applicable documentation.
PBT2 governs Buyer Protection, claims, remedies, evidence, returns, refunds, MyDeal Credit, shipping incidents, and Buyer-facing dispute resolution in greater detail. PBT1 does not limit mandatory Buyer rights under applicable law, but it does not create additional automatic remedies.
MyDealShopper may retain and use checkout records, authorizations, chats, videos, live-session records, photographs, receipts, Product Inventory, My Live Store, labels, packing slips, tracking, handoff, hub records, carrier scans, timestamps, payment records, and support records to verify orders, claims, shipping, substitutions, price changes, or incidents.
The Buyer may communicate with the Personal Shopper only through channels authorized by MyDealShopper. Instructions, authorizations, promises, agreements, or payments outside the platform may be invalid and do not bind MyDealShopper.
The Buyer must not pay the Personal Shopper directly or send external deposits, transfers, tips, gifts, cash, Zelle, PayPal, Cash App, bank payments, or other off-platform payments. Those payments are not protected by MyDealShopper and may result in cancellation, restriction, suspension, or loss of support.
Tips are valid only if MyDealShopper enables an official tipping feature within checkout or another authorized flow. Until such a feature is active, external tips and direct payments to the Personal Shopper are prohibited.
Processing of personal data, communications, addresses, payments, preferences, videos, images, purchase records, shipping, and support information is governed by MyDealShopper's Privacy Policy and applicable settings. The Buyer must not share sensitive data outside authorized channels.
The Personal Shopper may not promise refunds, returns, credits, MyDeal Credit, replacements, shipping outcomes, authenticity, price, availability, timing, customs clearance, specific results, or policy exceptions. Any remedy or final decision belongs to MyDealShopper under PBT2, checkout, and then-current documentation.
MyDealShopper may update PBT1 to reflect operational, legal, technical, commercial, risk, shipping, checkout, membership, Live Store, Private Shopping, MyDeal Credit, PBT2, or platform-function changes. The current version will be published through official channels. References to screen, module, button, tool, feature, or platform-element names are descriptive only. MyDealShopper may change its interface, terminology, design, flow, location, or functionality without amending PBT1, provided the rights and obligations established here are not materially changed.
This English version is the final controlling version for publication. If a Spanish or other translated version conflicts, is inconsistent, or differs in interpretation, this English version controls unless applicable law requires otherwise.
For questions concerning PBT1, Personal Shopper Orders, Live Stores, Private Shopping, checkout, shipping, or support, the Buyer must use the official channels made available by MyDealShopper in the platform, Help Center, Dashboard, order page, or then-current support flow.

Estos Términos de Compra para Buyers — Órdenes de Sellers regulan las condiciones aplicables cuando un Buyer compra productos ofrecidos por Sellers dentro de MyDealShopper, incluyendo compras realizadas mediante Live Store, checkout, productos mostrados durante lives, códigos de producto, catálogos, links, páginas de producto o cualquier flujo autorizado por MyDeal.
Estos Términos tienen como finalidad:
1. Explicar cómo funciona una compra realizada a un Seller dentro de MyDeal.
2. Establecer qué acepta el Buyer al comprar productos de Sellers.
3. Regular pagos, shipping, productos Final Sale, claims, devoluciones, refunds, almacenamiento, freight, duties, taxes, international shipping y Buyer Protection.
4. Alinear la experiencia del Buyer con las políticas aplicables a Sellers.
5. Proteger a Buyers, Sellers, MyDeal, MyDeal Xpress, carriers, hubs, payment processors y demás partes involucradas en la operación.
Estos Términos aplican únicamente a compras realizadas a Sellers con mercancía propia dentro de MyDeal.
Estos Términos no aplican a compras realizadas mediante Personal Shoppers, citas privadas, sourcing personalizado, servicios de concierge, compras asistidas, programas de creators, afiliados o servicios futuros, salvo que MyDeal indique expresamente que estos Términos aplican total o parcialmente. Dichos servicios podrán estar sujetos a términos, políticas, tarifas, claims, refunds, shipping, payout, storage o condiciones separadas.
Al crear una cuenta, usar MyDeal, navegar una Live Store, agregar productos al carrito, completar checkout, pagar una orden, aceptar un checkbox, solicitar shipping, presentar un Claim, contactar soporte o continuar usando la Plataforma, el Buyer acepta estos Términos.
MyDeal podrá conservar registros electrónicos de aceptación, incluyendo fecha, hora, usuario, email, IP, versión de términos, texto del checkbox, botón presionado, idioma, user agent y demás información razonablemente necesaria para documentar la aceptación.

Estos Términos no regulan compras realizadas mediante Personal Shoppers, citas privadas, sourcing personalizado, servicios de concierge, compras asistidas, programas de creators, afiliados o servicios futuros, salvo que MyDeal indique expresamente que estos Términos aplican total o parcialmente.

8. C7 — Seller Returns, Refunds and Claims Policy.
9. C8 — Seller Payouts, Reserves, Adjustments and Chargebacks Policy.
10. C9 — Seller Verification, Compliance and Eligibility Policy.
11. MyDeal Privacy Policy.
12. Buyer Protection and Claims Policy for Seller Orders / Política de Buyer Protection y Claims para Seller Orders, cuando sea publicada o aplicable.
13. MyDeal Xpress Logistics Terms, cuando aplique.
14. Stripe, PayPal u otros payment processor terms, cuando aplique.

Cuando exista conflicto entre estos Términos y una política más específica, la política más específica aplicará al producto, shipping, claim, refund, return, payout, freight, customs, category risk, hub issue o situación correspondiente, salvo que la ley aplicable exija otra cosa.

MyDeal opera como una plataforma que permite a Sellers vender productos a Buyers mediante Live Stores, checkout y herramientas relacionadas.
1. El Seller es responsable de los productos que publica y vende.
2. El Seller es responsable de la exactitud del listing.
3. El Seller es responsable de la condición, autenticidad, disponibilidad y cumplimiento del producto.
4. MyDeal facilita tecnología, checkout, pagos, soporte, shipping tools, hubs, claims, compliance y logística según corresponda.
5. MyDeal no garantiza que todo producto haya sido inspeccionado, autenticado o verificado antes de su publicación.
6. MyDeal puede intervenir para proteger al Buyer, aplicar políticas, procesar refunds, cancelar órdenes, solicitar evidencia o tomar medidas contra Sellers.
La compra dentro de MyDeal no convierte automáticamente a MyDeal en fabricante, propietario, importador oficial, autenticador, asegurador o vendedor directo del producto, salvo que MyDeal indique expresamente un modelo distinto en un servicio específico.
El Buyer entiende que la información del producto puede provenir del Seller, incluyendo:
1. Título.
2. Descripción.
3. Fotografías.
4. Videos.
5. Product Type.
6. Condition.
7. Key Details.
8. Precio.
9. Inventario.
10. Información de marca.
11. Información de tamaño, volumen, color, talla o cantidad.
12. Manifest, cuando aplique.
13. Información compartida durante lives.
14. Comentarios, chats o mensajes vinculados a la venta.
15. Representaciones realizadas por el Seller.
MyDeal podrá usar el listing, fotografías, live, evidencia del Buyer, evidencia del Seller, tracking, records de hub, información del carrier y demás elementos disponibles para resolver claims. Si existe contradicción entre lo publicado y lo dicho o mostrado por el Seller, MyDeal podrá considerar la representación que razonablemente haya influido en la decisión de compra del Buyer.
Antes de completar checkout, el Buyer debe revisar:
1. Nombre del producto.
2. Descripción.
3. Fotografías.
4. Product Type.
5. Condition.
6. Precio.
7. Cantidad.
8. Shipping aplicable.
9. Final Sale notices.
10. Freight notices.
11. Duties, taxes o customs notices.
12. Storage rules.
13. Claims deadlines.
14. Restricciones de destino.
15. Información de Pallet / Bulk Lot, cuando aplique.
16. Manifest, cuando exista.
17. Cualquier checkbox, aviso o condición mostrada antes del pago.
El hecho de que el Buyer no haya leído una descripción, fotografía, aviso o condición visible no crea automáticamente derecho a refund, return o claim, salvo que exista un problema cubierto por Buyer Protection.
Una orden se considera confirmada cuando:
1. El Buyer completa el checkout.
2. El pago es autorizado o procesado.
3. MyDeal confirma la orden o la pone disponible para procesamiento.
4. La orden no ha sido cancelada por falta de pago, revisión de riesgo, error, producto no disponible, restricción o incumplimiento.
MyDeal podrá cancelar o pausar una orden antes del fulfillment cuando exista:
1. Producto no disponible.
2. Error evidente de precio.
3. Restricción de producto.
4. Restricción de shipping.
5. Riesgo de fraude.
6. Payment review.
7. Sanctions / AML review.
8. Claim o reporte de seguridad.
9. Producto prohibido.
10. Seller no elegible.
11. Problema técnico.
12. Falta de información.
13. Cualquier otra razón legal, operativa, logística o de seguridad razonable.
El Buyer deberá pagar los montos mostrados en checkout, que pueden incluir:
1. Precio del producto.
2. Shipping inicial.
3. Large Item Shipping, Oversize Item / Special Cargo charges o special handling cuando aplique.
4. Sales tax, cuando aplique.
5. Fees aplicables.
6. Freight, cuando se incluya expresamente.
7. Otros cargos informados antes del pago.
Para ciertas compras internacionales, el checkout inicial puede no incluir todos los cargos finales de destino, incluyendo international final shipping, duties, taxes, customs fees, brokerage fees, import charges, storage fees, freight final, special handling o destination charges. Cuando dichos cargos se indiquen como separados, el Buyer seguirá siendo responsable de pagarlos conforme al flujo aplicable.
Las tarifas de shipping, cargos de Large Item, cargos de Oversize Item / Special Cargo, estimados de freight, storage fees, tarifas por paquete, shipping adjustments, special handling, carrier surcharges, hub charges, package rates y otros cargos operativos podrán cambiar conforme a costos de carriers, rutas, hubs, destino, peso, dimensiones, peso dimensional, disponibilidad logística, configuración del dashboard, checkout, Help Center, fee schedule o tarifas operativas de MyDeal vigentes al momento de la orden, cotización, generación de label, solicitud de freight, solicitud de shipping final o proceso aplicable.
Las cantidades mostradas en estos Términos, Help Center, checkout, dashboard, Shipping Rates Page o comunicaciones operativas podrán reflejar tarifas iniciales, tarifas vigentes, estimados o cargos aplicables según el flujo correspondiente. La tarifa aplicable será la que MyDeal muestre, publique, cotice o confirme en checkout, dashboard, Help Center, fee schedule, shipping quote, freight quote, label process o flujo operativo aplicable al momento de la operación.
MyDeal podrá actualizar tarifas, cargos, ajustes, thresholds, weight brackets, rutas, hubs, package rates o criterios de shipping sin necesidad de modificar estos Términos cada vez, salvo que la ley aplicable exija otra cosa.
MyDeal o sus proveedores de pago/tax podrán calcular, cobrar, reportar o remitir sales tax cuando aplique conforme a marketplace facilitator laws, tax rules o requirements aplicables.
El sales tax cobrado al Buyer no es ingreso del Seller.
Para compras internacionales, el Buyer puede ser responsable de:
1. Duties.
2. Import taxes.
3. Customs charges.
4. Brokerage fees.
5. Destination fees.
6. Regulatory fees.
7. Carrier import fees.
8. Otros cargos impuestos por autoridades, carriers, customs brokers o proveedores logísticos.
Estos cargos pueden no estar incluidos en el checkout inicial, salvo que MyDeal indique expresamente otra cosa.
Si el Buyer se niega a pagar duties, taxes, customs fees, freight, storage o international final shipping cuando dichos cargos son aplicables, la orden puede quedar retenida, almacenada, devuelta, abandonada, dispuesta o cancelada conforme a estos Términos, MyDeal Xpress Logistics Terms y políticas aplicables.
Para productos Standard elegibles enviados dentro de Estados Unidos, el checkout podrá mostrar:

Este cargo aplica conforme a las reglas de MyDeal, incluyendo Daily Sales Report, mismo Seller, mismo Buyer, misma dirección y productos Standard elegibles. El Buyer entiende que:
1. El cargo de shipping es administrado por MyDeal.
2. El cargo de shipping no es ingreso del Seller.
3. MyDeal selecciona o administra labels, carriers, rutas y procesos.
4. El shipping puede estar sujeto a ajustes internos.
5. La disponibilidad de Standard Shipping no garantiza entrega en una fecha exacta.
6. Productos Large Item, Oversize Item / Special Cargo o Pallet / Bulk Lot no entran automáticamente en Standard Shipping.
MyDeal puede usar un Daily Sales Report para agrupar compras del mismo Buyer al mismo Seller dentro de una ventana diaria.
Para v1, la ventana operativa puede ser:

Cuando el Buyer realiza compras Standard elegibles adicionales al mismo Seller dentro del mismo Daily Sales Report, el checkout puede mostrar:

Esto significa que el shipping inicial Standard para ese Seller y periodo ya fue cubierto conforme al flujo de MyDeal. Si el Buyer realiza compras después del cierre del Daily Sales Report, puede aplicarse un nuevo cargo de shipping.
Para Buyers internacionales, el checkout podrá mostrar:
US$4.99 Initial Shipping to MyDeal Hub
Este cargo cubre únicamente el tramo inicial desde el Seller hacia el hub asignado por MyDeal. El Buyer entiende que:
1. Este cargo no cubre necesariamente el envío final internacional.
2. El envío final desde el hub al país del Buyer se paga por separado.
3. MyDeal puede utilizar hubs autorizados por MyDeal.
4. MyDeal puede agrupar, consolidar, separar o procesar productos en el hub.
5. El shipping internacional final puede depender de peso, dimensiones, destino, carrier, país, duties, taxes y reglas de MyDeal Xpress.
6. El Buyer debe pagar el shipping internacional final para que el paquete sea enviado desde el hub al destino final.
Cuando una orden internacional llega a un MyDeal Hub, MyDeal o sus proveedores autorizados pueden:
1. Recibir paquetes.
2. Registrar paquetes.
3. Abrir cajas.
4. Separar productos por Buyer.
5. Verificar información básica.
6. Detectar faltantes visibles.
7. Consolidar productos.
8. Reempacar.
9. Preparar shipping internacional.
10. Calcular shipping final.
11. Solicitar pago al Buyer.
12. Retener temporalmente productos hasta que el Buyer complete instrucciones o pagos requeridos.
La recepción de un paquete en un hub no significa que MyDeal haya autenticado, certificado, inspeccionado completamente o aceptado toda la mercancía sin reserva.
El Buyer deberá solicitar, confirmar o pagar el envío internacional final conforme al flujo que MyDeal o MyDeal Xpress habilite. El costo final puede depender de:
1. País de destino.
2. Código postal.
3. Peso real.
4. Peso dimensional.
5. Tamaño del paquete.
6. Cantidad de productos.
7. Consolidación.
8. Carrier.
9. Duties.
10. Taxes.
11. Customs rules.
12. Producto restringido.
13. Categoría.
14. Nivel de servicio.
15. Seguro o protección adicional.
16. Special handling.
El Buyer entiende que los costos estimados no son necesariamente cotización final, salvo que MyDeal lo indique expresamente.
Para productos internacionales recibidos en hub, MyDeal puede ofrecer almacenamiento gratuito según el plan, membresía o regla aplicable.

Después del periodo gratuito:
1. Pueden aplicar storage fees.
2. MyDeal puede enviar avisos al Buyer.
3. El Buyer deberá solicitar envío final, consolidación, pickup autorizado o resolver su paquete.
4. Si el Buyer no responde, no paga o no completa el proceso, el paquete puede quedar sujeto a abandono, disposición, devolución, venta, donación, destrucción o manejo conforme a MyDeal Xpress Logistics Terms y ley aplicable.
Un paquete podrá considerarse abandonado si:
1. El Buyer no paga shipping internacional final.
2. El Buyer no responde a comunicaciones.
3. El Buyer no paga storage fees.
4. El Buyer no proporciona información requerida.
5. El Buyer no reclama su paquete dentro del plazo aplicable.
6. El Buyer rechaza entrega sin claim válido.
7. El Buyer se niega a pagar duties, taxes o customs fees.
8. El paquete no puede entregarse por causas atribuibles al Buyer.
Antes de disponer de un paquete, MyDeal podrá enviar avisos razonables conforme a sus políticas y la ley aplicable. El abandono puede resultar en pérdida del derecho del Buyer sobre el paquete, sin refund, salvo que la ley aplicable exija otra cosa.
Un Large Item, también referido operativamente como Oversize Item o Special Cargo cuando aplique, es un producto grande, pesado, voluminoso, frágil o no elegible para Standard Shipping.
Para v1, el checkout puede mostrar:

El Buyer entiende que:
1. Large Item no entra en Standard Shipping de US$4.99.
2. Large Item se maneja como flujo separado.
3. Large Item no se agrupa automáticamente con productos Standard.
4. Si la compra es internacional, el shipping final internacional puede pagarse por separado.
5. MyDeal puede requerir peso, dimensiones, validaciones o carrier especial.
6. La disponibilidad de Large Item, Oversize Item o Special Cargo puede variar por destino, carrier, ruta y categoría.
Los productos Pallet / Bulk Lot están sujetos a reglas especiales. Cuando el Buyer compra un Pallet / Bulk Lot, acepta que:
1. El lote se vende como unidad comercial especial.
2. El precio del lote no incluye freight, salvo que MyDeal indique expresamente otra cosa.
3. El freight se solicita, cotiza, confirma y paga por separado.
4. Los tabuladores o estimaciones de freight son informativos, no cotización final.
5. El lote no será liberado, recolectado, enviado ni entregado hasta que el freight aplicable sea resuelto conforme al proceso de MyDeal.
6. El lote puede estar sujeto a Final Sale.
7. El Buyer debe revisar descripción, fotografías, condición, manifest y freight notices antes de comprar.
8. MyDeal puede cancelar o pausar operaciones si el freight no es viable, si hay productos restringidos, si el lote no corresponde o si existe problema logístico.
El checkout o página del producto deberá mostrar de forma visible:

Y podrá incluir una aceptación similar a:

Salvo que MyDeal indique expresamente otra cosa, las ventas de Sellers son Final Sale respecto de:
1. Cambio de opinión.
2. Preferencia personal.
3. Buyer remorse.
4. Comparación de precio.
5. Expectativas de reventa.
6. Insatisfacción subjetiva.
7. No leer la descripción.
8. No revisar fotografías.
9. No revisar condiciones visibles.
10. No revisar shipping, freight, taxes o restricciones.
11. No pagar freight o international final shipping después de haber aceptado que era separado.
12. No obtener el margen esperado en una reventa.
13. No recibir marcas o productos específicos que no fueron garantizados.
14. Pallet / Bulk Lot sin manifest donde el contenido exacto no fue garantizado.
La regla de Final Sale no elimina Buyer Protection cuando exista un claim válido. El Buyer puede tener derecho a revisión si existe:
1. Producto incorrecto.
2. Producto no recibido.
3. Producto faltante.
4. Producto dañado antes de shipping o por empaque deficiente.
5. Producto materialmente distinto.
6. Producto falsificado.
7. Producto prohibido no declarado.
8. Producto sujeto a recall.
9. Perfume abierto, usado, sin caja permitida, falsificado o no conforme.
10. Beauty abierto, usado, vencido, reenvasado, falsificado o no conforme.
11. Luxury / Designer falso, réplica o materialmente distinto.
12. Pallet / Bulk Lot materialmente distinto al publicado.
13. Manifest materialmente incorrecto.
14. Freight incluido falsamente prometido.
15. No entrega atribuible al Seller, hub, carrier o proceso cubierto.
16. Error cubierto por políticas aplicables.
Salvo que exista otra base válida, generalmente no procederán claims por:
1. Cambio de opinión.
2. Buyer encontró mejor precio.
3. Buyer esperaba otro margen de reventa.
4. Buyer no leyó la descripción.
5. Buyer no revisó fotos.
6. Buyer no revisó Final Sale.
7. Buyer no revisó freight separado.
8. Buyer no revisó shipping internacional final.
9. Variaciones menores no materiales.
10. Desgaste o condición claramente descritos.
11. Insatisfacción subjetiva con olor, color, talla, estilo, fit o textura.
12. Duties, taxes o customs fees que el Buyer no esperaba pero eran aplicables.
13. Retrasos de aduana o carrier no atribuibles a MyDeal o Seller.
14. Pallet sin manifest que no contenía productos no garantizados.
15. Buyer abrió, usó, alteró o dañó el producto después de recibirlo.
16. Buyer proporcionó dirección incorrecta.
17. Buyer rechazó entrega sin claim válido.
18. Buyer no pagó shipping final o storage.
19. Buyer no respondió a comunicaciones necesarias.
20. Carrier claim no aprobado por carrier.
El Buyer deberá presentar claims dentro de los plazos indicados por MyDeal.

MyDeal podrá aceptar claims fuera de plazo si existe fraude, falsificación, producto prohibido, recall, safety issue, obligación legal, error grave o evidencia que justifique una excepción.
En órdenes internacionales, el plazo para presentar claim puede depender del momento en que el problema pudo detectarse razonablemente.

1. Fotografías del producto recibido.
2. Fotografías del empaque exterior.
3. Fotografías de shipping label.
4. Video de apertura, cuando exista.
5. Fotografías de daño.
6. Fotografías de accesorios faltantes.
7. Capturas del listing o live.
8. Descripción del problema.
9. Número de orden.
10. Tracking.
11. Evidencia de autenticidad o reporte externo en casos luxury.
12. Fotografías de lote o manifest discrepancies en pallets.
13. Documentos de customs, duties o carrier.
14. Carrier case number.
15. Declaración firmada.
16. Police report, cuando aplique.
17. Cualquier otra evidencia razonable según categoría.
La falta de evidencia suficiente puede resultar en rechazo o limitación del claim.
El Buyer no deberá devolver productos sin autorización previa de MyDeal. Una devolución válida puede requerir:
1. Aprobación de MyDeal.
2. Return label.
3. Dirección autorizada.
4. Carrier autorizado.
5. Plazo de envío.
6. Producto completo.
7. Empaque adecuado.
8. Accesorios incluidos.
9. Número de orden.
10. Evidencia de entrega.
Las devoluciones no autorizadas pueden ser rechazadas, no reembolsadas, retrasadas, devueltas al Buyer o tratadas conforme a políticas aplicables.
El Buyer no deberá devolver sin instrucciones de MyDeal:
1. Perfumes abiertos.
2. Beauty abierto.
3. Productos dañados o contaminados.
4. Productos peligrosos.
5. Productos prohibidos.
6. Productos falsificados.
7. Productos sujetos a safety issue.
8. Productos internacionales retenidos por customs.
9. Pallet / Bulk Lot.
10. Large Item / Oversize Item / Special Cargo.
11. Productos que requieran carrier especial.
12. Productos cuya devolución sea ilegal, insegura o no viable.
MyDeal podrá determinar si corresponde refund sin devolución, destrucción, disposición, devolución al Seller, revisión del producto o cualquier otro remedio permitido.
MyDeal podrá emitir refunds totales o parciales cuando:
1. Exista claim válido.
2. El Seller no pueda cumplir la orden.
3. El producto sea incorrecto.
4. El producto sea falso.
5. El producto sea prohibido.
6. El producto no sea entregado.
7. El producto sea materialmente distinto.
8. El producto esté dañado de forma cubierta.
9. MyDeal determine que Buyer Protection aplica.
10. La ley aplicable lo requiera.
11. El processor, carrier o policy applicable lo requiera.
Los refunds pueden excluir ciertos cargos no reembolsables cuando corresponda, incluyendo shipping ya utilizado, freight ya incurrido, duties, taxes, customs fees, storage fees, carrier fees, return fees, handling fees u otros cargos no recuperables, salvo que el problema sea atribuible al Seller, MyDeal o una parte cubierta.
MyDeal podrá cancelar una orden total o parcialmente cuando:
1. El Seller no tenga stock.
2. El Seller no pueda cumplir.
3. El producto esté mal clasificado.
4. El producto esté prohibido.
5. El producto no pueda enviarse.
6. El pago falle.
7. Exista fraude o risk review.
8. Exista error evidente de precio o listing.
9. El Buyer solicite cancelación antes del procesamiento, si MyDeal lo permite.
10. El Seller incumpla.
11. El carrier o hub no puedan procesar.
12. La ley o un tercero autorizado lo requiera.
13. MyDeal determine que la orden no es viable.
Si la cancelación ocurre antes de shipping y sin culpa del Buyer, MyDeal podrá emitir refund conforme a la situación aplicable.
Si tracking muestra delivered, pero el Buyer afirma no haber recibido el paquete, MyDeal podrá solicitar:
1. Confirmación de dirección.
2. Fotografías del área de entrega.
3. Carrier proof of delivery.
4. GPS o delivery scan, cuando esté disponible.
5. Declaración del Buyer.
6. Contacto con carrier.
7. Police report, cuando aplique.
8. Investigación interna.
Un estatus delivered no garantiza automáticamente rechazo del claim, pero el Buyer deberá cooperar con la investigación. MyDeal podrá negar el claim si la evidencia muestra entrega razonable o si existe fraude, dirección incorrecta, negativa de recepción, falta de cooperación o conducta sospechosa.
El Buyer es responsable de proporcionar dirección correcta, completa y entregable. Si el Buyer proporciona dirección incorrecta, incompleta, no entregable o no actualizada, puede ser responsable de:
1. Pérdida del paquete.
2. Retrasos.
3. Return to sender.
4. Reenvío.
5. Additional shipping.
6. Storage.
7. Duties.
8. Carrier fees.
9. Package abandonment.
10. No refund, salvo que la ley o MyDeal determine otra cosa.
Si una orden contiene producto prohibido, restringido, no habilitado o incompatible con shipping, MyDeal podrá:
1. Cancelar la orden.
2. Retener procesamiento.
3. Solicitar información.
4. Rechazar shipping.
5. Emitir refund.
6. Retener o disponer del producto cuando legalmente corresponda.
7. Cooperar con authorities, processors, carriers, brands o regulators.
8. Suspender al Seller.
9. Negar entrega si la ley o seguridad lo requiere.
El Buyer no tiene derecho a exigir entrega de un producto prohibido, ilegal, inseguro, restringido o no transportable.
Los perfumes y fragancias permitidos deben ser:
1. Nuevos.
2. Auténticos.
3. Cerrados.
4. Sin uso.
5. En empaque retail original intacto.
6. Correctamente publicados como Fragrance / Perfume.
El Buyer debe revisar tamaño, volumen, presentación, set, fotografías y descripción antes de comprar. Generalmente no se aceptarán returns por preferencia subjetiva de olor, intensidad, fijación, comparación con otro perfume o cambio de opinión, siempre que el producto coincida materialmente con el listing. Puede existir claim válido si el producto es falso, usado, abierto, sin empaque permitido, dañado, equivocado o materialmente distinto.
Los productos Beauty / Cosmetics permitidos deben ser:
1. Nuevos.
2. No abiertos.
3. No usados.
4. No vencidos.
5. No reenvasados.
6. No aerosol, salvo habilitación futura.
7. En empaque retail original intacto.
8. Correctamente publicados.
Generalmente no se aceptarán returns por tono subjetivo, textura, preferencia, cambio de opinión, comparación de precio o insatisfacción subjetiva si el producto coincide materialmente con el listing. Puede existir claim válido si el producto está abierto, usado, vencido, dañado, contaminado, falsificado, equivocado o materialmente distinto.
Los Luxury / Designer Items están sujetos a reglas especiales de autenticidad. El Buyer entiende que:
1. El Seller es responsable de publicar únicamente artículos auténticos.
2. MyDeal no autentica automáticamente cada artículo antes de su publicación.
3. La publicación en MyDeal no significa certificación automática de autenticidad.
4. MyDeal puede solicitar evidencia al Seller.
5. MyDeal puede revisar claims de falsificación o producto materialmente distinto.
6. El Buyer debe revisar fotos, condición, accesorios, seriales, descripción y Final Sale notices.
Puede existir claim válido si el artículo es falso, réplica, materialmente distinto, tiene daño no revelado, falta accesorio anunciado o no coincide con el listing. No habrá claim automático por desgaste claramente descrito, preferencia subjetiva, cambio de opinión o expectativas de reventa.
Los Pallet / Bulk Lot son Final Sale respecto de cambio de opinión, expectativas comerciales y preferencias subjetivas. No serán claims válidos por sí solos:
1. Buyer esperaba mayor margen.
2. Buyer esperaba otras marcas no garantizadas.
3. Buyer no revisó manifest.
4. Buyer compró lote sin manifest y esperaba contenido específico.
5. Buyer no consideró freight separado.
6. Buyer no obtuvo utilidad de reventa.
7. Buyer no leyó Final Sale.
Pueden ser claims válidos:
1. Lote materialmente distinto.
2. Manifest materialmente incorrecto.
3. Productos falsificados.
4. Productos prohibidos no declarados.
5. Lote no entregado.
6. Freight incluido falsamente prometido.
7. Daño atribuible antes de pickup.
8. Fraude.
9. Mercancía robada.
10. Condición materialmente distinta.
Si el Buyer inicia un chargeback o disputa con su banco, tarjeta o processor, MyDeal podrá:
1. Compartir evidencia con el processor.
2. Suspender review interno.
3. Solicitar información adicional.
4. Responder conforme a processor rules.
5. Limitar refunds duplicados.
6. Rechazar abuso de chargeback.
7. Aplicar políticas de fraude o account limitation.
8. Tomar medidas permitidas por ley.
El Buyer no debe recibir doble recuperación por el mismo problema mediante refund y chargeback simultáneo.
MyDeal podrá negar claims, limitar cuentas, cancelar órdenes o suspender acceso cuando detecte:
1. Claims falsos.
2. Chargebacks abusivos.
3. Fotografías manipuladas.
4. Dirección falsa.
5. Return fraud.
6. Empty box claims fraudulentos.
7. Uso indebido de promociones.
8. Reventa de datos.
9. Intento de obtener refund sin devolver producto cuando se requiere devolución.
10. Colusión con Seller.
11. Actividad sospechosa.
12. Sanctions / AML risk.
13. Conducta contraria a la ley o políticas.
MyDeal puede permitir o facilitar ciertas comunicaciones entre Buyer y Seller para resolver dudas, lives, productos u órdenes. El Buyer no deberá:
1. Mover transacciones fuera de MyDeal.
2. Pagar directamente al Seller por órdenes iniciadas en MyDeal.
3. Compartir información de pago fuera de la Plataforma.
4. Solicitar evasión de fees, shipping, taxes o Buyer Protection.
5. Amenazar, acosar o abusar de Sellers.
6. Solicitar productos prohibidos.
7. Pedir al Seller que altere declaraciones aduanales o información de shipping.
8. Usar datos del Seller para fines no relacionados con la orden.
MyDeal podrá limitar comunicaciones, cancelar órdenes o suspender cuentas si detecta abuso.
MyDeal no garantiza:
1. Que un producto permanezca disponible.
2. Que un Seller mantenga inventario.
3. Que un precio no contenga error evidente.
4. Que shipping esté disponible a todos los destinos.
5. Que carriers entreguen sin retraso.
6. Que customs libere un paquete.
7. Que un producto sea aceptado por todos los países.
8. Que un Pallet / Bulk Lot produzca margen de reventa.
9. Que un producto se entregue en fecha exacta.
10. Que un live o Seller continúe activo.
MyDeal podrá modificar estos Términos para reflejar:
1. Cambios operativos.
2. Nuevas categorías.
3. Cambios en shipping.
4. Nuevos hubs.
5. Cambios de carrier.
6. Cambios legales.
7. Cambios fiscales.
8. Cambios de compliance.
9. Cambios de Buyer Protection.
10. Cambios de claims, refunds o storage.
11. Cambios de payment processors.
12. Nuevos servicios.
El uso continuo de MyDeal después de publicada una actualización puede constituir aceptación de la versión actualizada, en la medida permitida por la ley aplicable.
MyDeal podrá enviar avisos relacionados con:
1. Órdenes.
2. Pagos.
3. Shipping.
4. Hubs.
5. Storage.
6. Claims.
7. Refunds.
8. Returns.
9. Chargebacks.
10. Términos.
11. Políticas.
12. Seguridad.
13. Compliance.
14. Account status.
15. International shipping.
16. Freight.
17. Abandonment.
18. Legal notices.
Los avisos podrán enviarse mediante email, dashboard, account messages, platform alerts, SMS cuando esté permitido, soporte o cualquier otro método electrónico razonable. El Buyer es responsable de revisar sus canales registrados.
El uso de información personal del Buyer se regula por la MyDeal Privacy Policy. MyDeal puede procesar información del Buyer para:
1. Crear cuenta.
2. Procesar checkout.
3. Procesar pago.
4. Coordinar shipping.
5. Resolver claims.
6. Prevenir fraude.
7. Cumplir obligaciones legales.
8. Compartir información necesaria con Sellers, carriers, hubs, processors, tax providers, logistics providers y autoridades cuando aplique.
En la máxima medida permitida por la ley aplicable, MyDeal no será responsable por:
1. Pérdidas indirectas.
2. Lucro cesante.
3. Pérdida de oportunidad de reventa.
4. Pérdida de margen esperado.
5. Daños consecuenciales.
6. Retrasos de carrier.
7. Customs delays no atribuibles a MyDeal.
8. Errores del Buyer.
9. Uso indebido de la Plataforma.
10. Productos publicados por Sellers, salvo responsabilidades que la ley no permita excluir.
11. Fallas de terceros.
12. Eventos fuera del control razonable de MyDeal.
La responsabilidad de MyDeal, si existe, podrá limitarse al monto pagado por el Buyer por la orden afectada, salvo que la ley aplicable exija otra cosa.
Nada en estos Términos constituye asesoría legal, fiscal, aduanal, regulatoria, financiera, de importación/exportación o profesional. El Buyer es responsable de entender sus obligaciones respecto de:
1. Importación.
2. Duties.
3. Taxes.
4. Customs.
5. Reventa.
6. Licencias.
7. Permisos.
8. Restricciones de país.
9. Uso del producto.
10. Cumplimiento legal aplicable.
Salvo que la ley aplicable exija otra cosa, estos Términos se regirán por las leyes del Estado de Wyoming, Estados Unidos, sin dar efecto a principios de conflicto de leyes.
Cualquier disputa deberá manejarse conforme a los procedimientos de revisión interna de MyDeal antes de iniciar acciones legales, salvo que se requiera medida urgente, injunctive relief, fraud prevention, chargeback response, processor compliance o cumplimiento legal inmediato.
Si estos Términos se proporcionan en más de un idioma, la versión en inglés prevalecerá en caso de conflicto, salvo que la ley aplicable exija otra cosa.
Estos Términos son incorporados al proceso de compra del Buyer dentro de MyDeal.
El Buyer acepta estos Términos al:
1. Crear cuenta.
2. Usar la Plataforma.
3. Navegar una Live Store.

6. Pagar una orden.

12. Presentar un Claim.

14. Usar soporte.
15. Continuar usando MyDeal después de cambios.

Términos de Compra para Buyers en Órdenes con Personal Shopper de MyDealShopper
Nota de idioma. Esta es la versión española final para publicación. La versión española será la versión pública vigente hasta que MyDealShopper publique una versión inglesa identificada expresamente como controlante. A partir de entonces, la versión inglesa prevalecerá en caso de conflicto, inconsistencia o diferencia de interpretación, salvo que la ley aplicable exija otra cosa.
PBT1 establece los términos aplicables a Buyers cuando compran mediante Personal Shopper Orders, Live Stores, Private Shopping, Assisted Purchase, productos publicados en My Live Store o compras físicas asistidas realizadas a través de MyDealShopper.
Este documento explica al Buyer las condiciones comerciales y operativas de este tipo de compra. PBT1 no promete disponibilidad, precio final, sustitución, devolución, refund, MyDeal Credit, shipping, entrega internacional, customs clearance, autenticidad, reemplazo o resultado específico.
PBT1 forma parte del marco contractual Buyer-facing de MyDealShopper y debe leerse junto con GT1 — MyDealShopper Terms of Use, PP1 — Privacy Policy, MT1 — Membership Terms cuando corresponda, PBT2 — Buyer Protection, Claims and Remedies for Personal Shopper Orders, y los términos, disclosures y condiciones específicos mostrados en checkout, booking page, order page, shipping flow o Help Center para la operación concreta.
PS1–PS5, PS-OCS y PS-OCS Active Schedule son documentos internos o contractuales utilizados por MyDealShopper para administrar al Personal Shopper, su operación, compensación, cumplimiento e investigación de incidentes. No se incorporan al acuerdo del Buyer, no imponen obligaciones al Buyer y no requieren aceptación del Buyer. MyDealShopper podrá utilizarlos internamente para administrar la orden y determinar responsabilidades, sin reducir los derechos Buyer-facing establecidos en PBT1, PBT2, checkout o la ley aplicable.
Si una orden corresponde a un Seller que vende su propio inventario, aplicarán las reglas de Seller Orders y Seller Terms. Si la compra se realiza mediante un Personal Shopper, aplica PBT1 junto con los documentos Buyer-facing y operativos correspondientes.
PBT1 aplica a compras, reservas, autorizaciones y órdenes realizadas por Buyers mediante Personal Shoppers dentro de MyDealShopper, incluyendo Live Store, Private Shopping, Assisted Purchase, productos publicados en Product Inventory / My Live Store, checkout, MyDeal Credit, sustituciones, cambios de precio, productos no disponibles, shipping USA, shipping internacional, hubs, labels, handoff, drop-off y Pickup Approved cuando esté habilitado.
PBT1 no regula en detalle claims, returns o Buyer Protection; esos temas se desarrollan en PBT2. Tampoco regula pagos internos al Personal Shopper, conducta del Personal Shopper ni procesos internos completos.
Buyer: usuario que compra, reserva, autoriza o solicita una compra asistida mediante MyDealShopper.
Personal Shopper: prestador independiente autorizado por MyDealShopper para asistir al Buyer en compras físicas, Live Stores, Private Shopping o Assisted Purchase. El Personal Shopper no es Seller por el solo hecho de asistir una compra.
Personal Shopper Order: orden en la que el Buyer compra o autoriza la compra de productos mediante un Personal Shopper, sujeta a disponibilidad real en tienda, checkout, autorización, reglas de shipping, evidencia y flujo operativo de MyDealShopper.
Live Store: experiencia de compra asistida en vivo operada por un Personal Shopper desde una tienda, outlet, mall, evento o lugar autorizado, donde los productos pueden publicarse en My Live Store y comprarse a través de MyDealShopper.
Private Shopping: cita privada de compra asistida en la que un Personal Shopper atiende al Buyer conforme a la reserva, tarifa, duración, buffer operativo y reglas vigentes.
Assisted Purchase: compra física o asistida ejecutada por un Personal Shopper conforme al flujo autorizado por MyDealShopper.
My Live Store: espacio operativo donde se muestran productos publicados por un Personal Shopper durante una Live Store o flujo habilitado.
Product Inventory: herramienta donde el Personal Shopper registra o administra productos para My Live Store o flujos habilitados.
Product Published / Producto publicado: producto visible, registrado o mostrado en My Live Store o Product Inventory. Un producto publicado no equivale a producto reservado, apartado, comprado o garantizado.
Seller Order: orden relacionada con un Seller que vende su propio inventario bajo Seller Terms. No debe confundirse con Personal Shopper Order.
Live Deals: promociones, ofertas, campañas o contenidos comerciales que pueden incluir Sellers u otros formatos. No deben confundirse con Live Stores operadas por Personal Shoppers.
MyDeal Credit: crédito dentro de la plataforma que MyDealShopper puede emitir como remedio Buyer-facing cuando corresponda. No es automático ni garantizado.
Checkout: flujo mediante el cual el Buyer revisa, confirma, paga, preautoriza o autoriza una orden, cita, comisión, shipping, taxes, fees u otros cargos aplicables.
Authorization / Autorización: aprobación del Buyer o de MyDealShopper, dentro del flujo aplicable, para iniciar, continuar, ajustar, sustituir o completar una compra.
Substitution / Sustitución: reemplazo de un producto, variante, talla, color, modelo, condición, presentación o bundle por otro producto o variante autorizada conforme al flujo aplicable.
Handoff: entrega registrada del producto al carrier, hub, punto autorizado, Personal Shopper autorizado, Buyer o persona autorizada según el flujo aplicable.
Hub: punto operativo, centro de consolidación, recepción o procesamiento utilizado por MyDealShopper para flujos logísticos domésticos o internacionales.
Carrier: proveedor de transporte, paquetería o logística utilizado para mover una orden dentro de USA, hacia un hub o hacia un destino internacional.
Pickup Approved: modalidad operativa habilitada expresamente por MyDealShopper para que ciertas órdenes puedan entregarse directamente al Buyer o persona autorizada, bajo requisitos específicos de elegibilidad y evidencia.
Una Seller Order involucra a un Seller que vende su propio inventario bajo Seller Terms. Una Personal Shopper Order involucra una compra asistida en la que el Personal Shopper ayuda al Buyer a adquirir productos disponibles en una tienda, outlet, mall, evento o lugar autorizado. En una Personal Shopper Order, la disponibilidad, precio final, condición, variantes, restricciones de tienda y shipping pueden cambiar antes de que la compra física se complete.
Live Deals puede referirse a ofertas, promociones, campañas o contenido comercial que no necesariamente es operado por un Personal Shopper. Live Store es una experiencia de compra asistida operada por un Personal Shopper en tiempo real o conforme al flujo habilitado. Una Live Store no convierte al Personal Shopper en Seller ni garantiza disponibilidad del producto mostrado.
Una Personal Shopper Order es una orden sujeta a checkout, autorización, disponibilidad real en tienda, posibles cambios de precio, sustituciones, restricciones de categoría, shipping, handoff, hub, carrier y revisión operativa. El Buyer entiende que el producto puede no estar reservado hasta que sea físicamente comprado o confirmado conforme al flujo aplicable.
Una Live Store permite al Buyer comprar productos mostrados o publicados por un Personal Shopper durante un live o flujo habilitado. Los productos visibles en My Live Store se encuentran sujetos a disponibilidad, precio, restricciones de tienda, Product Types, shipping y autorización aplicable.
Private Shopping es una cita privada de compra asistida. La tarifa de Private Shopping cubre el tiempo y servicio de asistencia del Personal Shopper, no el precio de productos, taxes, shipping, duties, insurance, platform fees, comisión sobre productos ni otros cargos, salvo que el checkout indique expresamente lo contrario.
Un producto publicado en Product Inventory o My Live Store no significa que el producto esté apartado, reservado, garantizado, comprado o disponible al momento de checkout o compra física. La tienda puede cambiar precio, stock, promociones, políticas, restricciones o disponibilidad sin control de MyDealShopper.
Los productos mostrados durante una Live Store o Private Shopping que aún no hayan sido publicados en Product Inventory o My Live Store también estarán sujetos a disponibilidad real en tienda, precio final, autorización, checkout, restricciones de tienda, sustituciones y flujo operativo aplicable antes de poder comprarse.
Las Personal Shopper Orders dependen de disponibilidad real en tienda. El Buyer reconoce que un producto mostrado en live, publicado en My Live Store o solicitado durante Private Shopping puede agotarse, variar, estar dañado, estar restringido, ser final sale o no poder comprarse por reglas de tienda, carrier, MyDealShopper o país de destino.
El precio real puede variar respecto del precio visto inicialmente, publicado, comentado o estimado. Si el precio final resulta menor, MyDealShopper podrá reflejar la diferencia mediante MyDeal Credit, ajuste interno, refund parcial u otro mecanismo mostrado en checkout o determinado por MyDealShopper. Si el precio sube dentro del Price Tolerance vigente, la compra podrá completarse conforme al disclosure, checkout o flujo aplicable. Si supera el Price Tolerance, podrá requerirse nueva autorización.
El sales tax puede variar por tienda, estado, ciudad, categoría, promoción, shipping destination o configuración de checkout. Diferencias de sales tax no necesariamente constituyen un cambio de precio del producto, y serán tratadas conforme al checkout y reglas fiscales aplicables.
El Buyer puede ser responsable de shipping, duties, customs, insurance, platform fees, processor fees, impuestos, cargos regulatorios, cargos de importación/exportación u otros conceptos aplicables. Estos cargos pueden mostrarse o calcularse en checkout, order page, shipping flow o documentación vigente.
El Buyer debe revisar y completar checkout, pago, preautorización o autorización aplicable antes de que MyDealShopper o el Personal Shopper ejecuten la compra, salvo programas especiales autorizados por MyDealShopper. Comentarios en live, mensajes, capturas, intención verbal o solicitudes informales no sustituyen checkout ni autorización válida.
Cuando el checkout, order page, booking page, shipping flow o pantalla de confirmación muestre información específica para una orden, cita o compra determinada, incluyendo precio, cargos, impuestos, shipping, duties, comisiones, autorizaciones, disclosures, restricciones o condiciones particulares, dicha información complementará PBT1 y prevalecerá para esa operación en caso de diferencias operativas no sustanciales.
Una Personal Shopper Order nace formalmente cuando el Buyer completa checkout y el pago o autorización es aceptado por MyDealShopper o su procesador de pago. Antes de ese momento, MyDealShopper no garantiza que el producto será comprado, reservado o procesado.
El Personal Shopper solo puede comenzar la compra cuando la orden haya sido autorizada por MyDealShopper y el Personal Shopper reciba la notificación o confirmación de compra dentro del flujo de MyDealShopper. El Buyer entiende que ningún acuerdo externo autoriza al Personal Shopper a comprar fuera del sistema.
Si un producto no está disponible, no puede comprarse, cambió de condición, se agotó, está restringido o requiere autorización adicional, MyDealShopper podrá omitirlo, cancelarlo, sustituirlo cuando esté autorizado, emitir MyDeal Credit, procesar un ajuste o resolverlo conforme a PBT2, checkout, Dashboard o flujo de soporte vigente.
Si el Buyer no responde a una solicitud de autorización, sustitución, cambio de precio, condición especial, Final Sale, Open Box, bundle o cambio material, el Personal Shopper no debe comprar sin autorización cuando esta sea requerida. MyDealShopper podrá omitir el producto, cancelar esa parte de la orden, aplicar preferencias previamente configuradas cuando existan o resolver conforme al flujo aplicable.
Las sustituciones pueden aplicar cuando un producto, variante, talla, color, modelo, condición o bundle no está disponible o requiere ajuste. Una sustitución puede requerir autorización expresa del Buyer o estar cubierta por preferencias configuradas cuando el sistema lo permita.
Una sustitución requerirá autorización cuando implique cambio material de producto, talla, color, modelo, condición, presentación, bundle, precio, categoría, marca, disponibilidad, final sale, open box o cualquier elemento que razonablemente afecte la decisión del Buyer.
Cuando MyDealShopper habilite preferencias de sustitución, el Buyer podrá configurar preferencias antes o durante el flujo de compra. En Live Store podrán aplicarse preferencias preconfiguradas cuando el sistema lo permita; en Private Shopping el Buyer podrá autorizar sustituciones durante la cita por canales aprobados.
Los cambios de talla, color, modelo, condición, presentación, bundle o versión no se consideran equivalentes automáticamente. Pueden requerir autorización expresa, evidencia adicional o revisión, incluso si el precio se mantiene dentro del Price Tolerance.
Un producto Final Sale puede no ser retornable, reembolsable o cambiable por la tienda. Si el Buyer autoriza o completa checkout para un producto Final Sale, entiende que la devolución puede no estar disponible y que MyDealShopper no garantiza que la tienda acepte return, refund o exchange.
Productos Open Box solo deberán comprarse cuando estén permitidos y autorizados conforme al flujo aplicable. Pueden tener condición, empaque, accesorios, garantía, returnability o disponibilidad diferente. El Buyer entiende que estos productos pueden requerir evidencia o autorización adicional.
Productos Clearance pueden estar sujetos a precio final, disponibilidad limitada, no devolución, restricciones de tienda, falta de empaque completo o cambios rápidos de stock. MyDealShopper no garantiza que puedan devolverse o reemplazarse.
Productos de beauty, fragrance, cosmetics o skincare pueden estar sujetos a restricciones de higiene, shipping, carrier, importación, empaque sellado, no devolución, final sale o manejo especial. Productos abiertos, usados, derramados, vencidos visiblemente o con empaque comprometido pueden no ser elegibles, salvo autorización expresa.
MyDealShopper no garantiza autenticidad por cuenta propia salvo que una política, programa, verificación, tienda autorizada, documentación o disclosure específico lo indique. Cuando un producto se compra en tienda oficial, outlet oficial o retailer autorizado, la evidencia principal será el recibo, tienda, empaque y registros disponibles.
Electronics pueden estar sujetos a modelo exacto, compatibilidad, región, batería integrada, garantía, serial number, activación, carrier restrictions, import/export rules o defectos técnicos no detectables. MyDealShopper no garantiza funcionamiento técnico salvo políticas específicas aplicables.
Productos usados o de segunda mano no estarán permitidos salvo que MyDealShopper habilite expresamente la categoría, tienda, condición o programa correspondiente. Si se habilitan, podrán estar sujetos a mayor evidencia, restricciones y ausencia de garantías o returns.
El Buyer no debe solicitar productos prohibidos o restringidos, incluyendo medicamentos, alcohol, tabaco, CBD, armas, municiones, animales, alimentos perecederos, material peligroso y cualquier producto prohibido por ley, carrier, tienda, MyDealShopper, país de origen, país de destino o regla de importación/exportación aplicable.
Las compras dependen de reglas de tiendas, malls, outlets, eventos, seguridad, staff, políticas de grabación, límites de cantidad, membresías, final sale, returns, métodos de pago, disponibilidad y restricciones de terceros. MyDealShopper no controla dichas reglas.
Live Stores pueden transmitirse en plataformas externas como TikTok, Instagram, Facebook u otras redes, cuando aplique. Dichas plataformas tienen reglas propias y pueden cortar, restringir o eliminar transmisiones. Si el live externo se interrumpe, la Live Store en MyDealShopper puede seguir activa hasta que el Personal Shopper finalice el servicio dentro de MyDealShopper, conforme al flujo vigente.
La tarifa de Private Shopping se cobra al reservar. La duración visible, buffer operativo, tarifa vigente, split económico y condiciones de elegibilidad se publican en checkout, Dashboard, PS-OCS, Active Schedule, Help Center o documentación vigente. La tarifa de la cita puede no incluir productos ni cargos adicionales.
Cuando aplique, el Buyer podrá visualizar antes de reservar o comprar la comisión del Personal Shopper, ya sea como porcentaje, monto fijo, comisión por producto o configuración habilitada. La comisión puede variar por Live Store, Private Shopping, producto, región, campaña, categoría o Active Schedule.
Salvo que MyDealShopper indique expresamente lo contrario, taxes, shipping, duties, insurance, platform fees, processor fees, tips oficiales cuando estén habilitados, cargos financieros y otros cargos adicionales no forman parte de la comisión del Personal Shopper y se cobran por separado conforme al checkout.
Los beneficios, descuentos, tarifas, prioridad, shipping, funciones o condiciones de compra pueden variar según membresía Free, Plus, Business u otra membresía vigente, conforme a MT1, checkout, Dashboard, Help Center o documentación aplicable. PBT1 no promete beneficios específicos por membresía.
MyDealShopper no garantiza que un producto mostrado, publicado, comentado o solicitado esté disponible al momento de compra física. La disponibilidad depende de tienda, stock, staff, restricciones, promociones, horario, ubicación y otros factores externos.
MyDealShopper no garantiza precio final salvo lo confirmado o autorizado en checkout y sujeto a Price Tolerance, sales tax, shipping, duties, cargos adicionales, cambios de tienda, sustituciones y reglas aplicables.
MyDealShopper no garantiza autenticidad por cuenta propia salvo programa, verificación, retailer autorizado, documentación o disclosure específico. El Buyer debe revisar la información disponible y entender que claims de autenticidad se manejarán conforme a PBT2 y evidencia aplicable.
La aceptación de returns depende de tienda, condición, categoría, fecha, recibo, método de pago, Final Sale, Open Box, clearance, higiene, shipping, importación y restricciones aplicables. MyDealShopper no garantiza que una tienda acepte devolución, exchange, refund o store credit.
MyDealShopper no garantiza tiempos específicos, aceptación aduanal, ausencia de duties, import clearance, disponibilidad de carrier, costos finales de aduana o resultado logístico internacional. Los envíos internacionales pueden estar sujetos a revisión, restricciones, documentación, hubs y carrier final.
Para envíos dentro de Estados Unidos, MyDealShopper podrá usar carrier, shipping labels, handoff, drop-off, pickup, hub o flujo doméstico aplicable. La disponibilidad de cada método dependerá del checkout, dirección, producto, carrier, categoría y configuración vigente.
Para envíos internacionales, MyDealShopper administra el proceso logístico aplicable, incluyendo hub, consolidación, revisión, documentación, shipping internacional, carrier final, customs, duties, import/export restrictions y tarifas mostradas al Buyer cuando elija envío internacional. La selección de envío internacional no garantiza ausencia de cargos adicionales, demoras o restricciones.
Handoff significa entrega registrada conforme al flujo aplicable, incluyendo carrier, hub, punto autorizado, drop-off, pickup aprobado o entrega a persona autorizada. La orden puede requerir evidencia de handoff antes de continuar el flujo logístico o de soporte.
Pickup Approved solo está disponible cuando MyDealShopper lo habilite expresamente para una orden, zona, Buyer, Personal Shopper o programa. El Buyer no puede exigir Pickup Approved si no aparece como opción habilitada o si MyDealShopper lo retira por razones operativas, de seguridad, riesgo o cumplimiento.
Si el Buyer cancela antes de que el producto sea comprado, la cancelación se resolverá conforme al checkout, PBT2, Cancellation Policy, Dashboard, Help Center o flujo de soporte vigente. PBT1 no promete refund, MyDeal Credit o remedio automático.
Si el Buyer cancela después de que el producto fue comprado, la orden puede estar sujeta a políticas de tienda, Final Sale, shipping, importación, returns, store credit, MyDeal Credit, PBT2 y costos ya incurridos. La cancelación posterior a compra no garantiza refund ni devolución.
Si el Buyer cambia de opinión antes de compra, MyDealShopper podrá resolver conforme al flujo aplicable. Si cambia de opinión después de compra, no se garantiza devolución, refund, store credit, MyDeal Credit, reemplazo o cancelación. El Personal Shopper no decide ni promete remedios.
Cuando una tienda emita store credit, gift card, refund, cashback, points, rewards, coupon, price adjustment u otro beneficio derivado de una Personal Shopper Order, MyDealShopper determinará su tratamiento conforme a PBT2, checkout y políticas aplicables. El Buyer no debe asumir que dichos beneficios se entregarán automáticamente, salvo confirmación de MyDealShopper.
MyDeal Credit puede ser ofrecido por MyDealShopper como posible remedio Buyer-facing cuando corresponda. No es automático, no está garantizado y se regula conforme a PBT2, checkout, Dashboard, Help Center o documentación aplicable.
PBT2 regulará Buyer Protection, claims, remedies, evidence, returns, refunds, MyDeal Credit, shipping incidents y resolución de disputas Buyer-facing en mayor detalle. PBT1 no limita derechos obligatorios del Buyer bajo ley aplicable, pero no crea remedies automáticos adicionales.
MyDealShopper podrá conservar y utilizar registros de checkout, autorizaciones, chats, videos, lives, fotos, recibos, Product Inventory, My Live Store, labels, packing slips, tracking, handoff, hub, carrier scans, timestamps, payment records y soporte para verificar órdenes, claims, shipping, sustituciones, cambios de precio o incidencias.
El Buyer puede comunicarse con el Personal Shopper únicamente mediante canales autorizados por MyDealShopper. Instrucciones, autorizaciones, promesas, acuerdos o pagos fuera de la plataforma pueden no ser válidos y no obligan a MyDealShopper.
El Buyer no debe pagar directamente al Personal Shopper, enviar depósitos, transferencias, tips externos, gifts, cash, Zelle, PayPal, Cash App, pagos bancarios u otros medios fuera de MyDealShopper. Dichos pagos no están protegidos por MyDealShopper y pueden causar cancelación, restricción, suspensión o pérdida de soporte.
Las propinas solo serán válidas si MyDealShopper habilita una función oficial dentro del checkout o flujo autorizado. Mientras dicha función no esté activa, no se permiten tips externos ni pagos directos al Personal Shopper.
El tratamiento de datos personales, comunicaciones, dirección, pagos, preferencias, videos, imágenes, registros de compra, shipping y soporte se rige por la Privacy Policy de MyDealShopper y las configuraciones aplicables. El Buyer no debe compartir datos sensibles fuera de los canales autorizados.
El Personal Shopper no puede prometer refunds, returns, credits, MyDeal Credit, replacements, shipping outcomes, autenticidad, precio, disponibilidad, tiempos, customs clearance, resultados específicos o excepciones de política. Cualquier remedio o decisión final corresponde a MyDealShopper conforme a PBT2, checkout y documentación vigente.
MyDealShopper podrá actualizar PBT1 para reflejar cambios operativos, legales, técnicos, comerciales, de riesgo, shipping, checkout, membresías, Live Stores, Private Shopping, MyDeal Credit, PBT2 o funcionamiento de la plataforma. La versión vigente será publicada por MyDealShopper conforme a sus canales oficiales.
Las referencias a nombres de pantallas, módulos, botones, herramientas, funciones o elementos de la plataforma tienen fines descriptivos. MyDealShopper podrá modificar su interfaz, nomenclatura, diseño, flujo, ubicación o funcionamiento sin necesidad de modificar PBT1, siempre que no cambien sustancialmente los derechos y obligaciones aquí establecidos.
Esta es la versión española final para publicación. La versión española será la versión pública vigente hasta que MyDealShopper publique una versión inglesa identificada expresamente como controlante. A partir de entonces, la versión inglesa prevalecerá en caso de conflicto, inconsistencia o diferencia de interpretación, salvo que la ley aplicable exija otra cosa.
Para preguntas relacionadas con PBT1, Personal Shopper Orders, Live Stores, Private Shopping, checkout, shipping o soporte, el Buyer deberá comunicarse mediante los canales oficiales habilitados por MyDealShopper en la plataforma, Help Center, Dashboard, order page o soporte vigente.
